maintenance of vehicle off-street parking within the City.
12-03-76 - Resolution No, 12613 adopted, making a finding that the public interest,
convenience and necessity required the formation of a parking improvement district.
06-19-00 - Resolution No. 2000-207 was adopted, confirming the 2000/2001 Assessment Roll
for Central City Parking District No. 947 (RollI-Bonded portion only).

After the passage of Proposition 218 and prior to FY 2000/200 I, the Economic Development
Agency funded the maintenance, operation and security costs for the district lots, and Roll 2,
Pursuant to an Agreement between the City and the EDA, the Agency was to pay the
assessments on parcels acquired in the District after the district was formed. Last year, it was
agreed to by the City and Agency, that the Agency would no longer be able to fund the non-
assessable costs of the Parking District.
The bond payment for this year is $180,200 per the schedule in the Official Statement. Since this
is the last year of assessments for the District, the Agency, which administers the bonds, has
advised us that there are some surplus reserves and the final payment should only be
$163,394.98, They had also stated that they would still be willing to participate in paying the
assessments on EDA owned parcels if the assessments would be lowered by the difference in the
scheduled payment and the actual payment, which is $11,805.02. As shown on the sununary
attached, this amount is reflected as a credit toward their payment.
On April 19, 2001, the Parking Place Commission, by unanimous vote, recommended approval
of the 2001/2002 Assessment Roll, with the recommendation that the $11,805.02 savings to the
Agency be transferred to the Parking District maintenance fund to offset the costs of deferred
maintenance, The Director of Facilities Management, who is responsible for the maintenance of
the district lots, has indicated that lot 3 was in need of re-paving and re-striping and $11,805
would cover only a portion of the needed work. EDA has, however, indicated to us that due to
budget constraints, they would recommend against such a transfer of funds. Therefore, the
transfer will not take place. .
As stated above, this will be the last and final assessment on this District. At the end of FY
2001/2002, staff will submit a Resolution terminating the District and releasing liens.
FINANCIAL IMPACT:
If the assessments are not approved, the proposed assessment roll will have to be funded from
the General Fund. Funding for the maintenance, operation and security costs for the 3 lots,
which is carried out by Facilities Management, and estimated to be $98,800 for FY 2001/2002,
will need to be funded from the General Fund.
RECOMMENDATION:
Staffrecommends that the 2001/2002 Assessment Rolli for the Downtown Central Parking
District be approved.

RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE
2001/2002 ASSESSMENT ROLL FOR ACQUISITION AND IMPROVEMENT~ FOR
THE DOWNTOWN CENTRAL CITY PARKING DISTRICT NO. 947 (ROLL 1 ONLY).
WHEREAS, by Resolution No. 12613, the Mayor and Common Council found that the
public interest, convenience, and necessity required the formation of a parking improvement
7 district; and
WHEREAS, by said Resolution No. 12613, the Mayor and Common Council formed a

9 parking improvement district for the purpose of providing public off-street parking facilities in
10
the City of San Bernardino pursuant to the provisions of Ordinance No. 3589 relating to the
11
establishment, financing, operation and maintenance of vehicle off-street parking within the
12
City; and
13

WHEREAS, said Resolution No. 12613 declared that all land within the boundaries of
15 said parking improvement district will be benefited by the parking improvements to be
16 constructed; and
17 WHEREAS, by Resolution No. .12613 declared that an annual assessment shall be
18 levied on all land within the district to provide funding for the acquisition and improvement of
19

parking spaces the maintenance and operation thereof and the furnishing of security therefore;
and
WHEREAS, an Assessment Roll has been prepared totaling $48.081.95, which sets
23 forth the individual assessments for acquisition and improvements to be levied on each of the
24 parcels of land within the Central City Parking District No. 947 for the fiscal year 2001/2002;
25 and

WHEREAS, Article XIII D of the California Constitution requires that any and all

Assessment Districts existing on the effective date of said Article XIII D shall comply with the

procedural and approval process as set forth in Section 4 of said Article XIII D, except as set
forth in Section 5 therein.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council do hereby find and determine that
the assessments for the costs of maintenance, operation and security for the Central City Parking
District No. 947 are not exempt from the procedural and approval requirements of Article XIII
D of the California Constitution, as provided for under Section 5 of said Article XIII D; and
SECTION 2. That the Mayor and Common Council do hereby find and determine that
13 the assessments as set forth on said Assessment Roll No. 947, on file in the office of the City
14 Clerk of said City, for acquisition and improvements only, exclusive of maintenance, operation
15 and security costs are hereby exempt from the procedural and approval requirements of Article
16
XIII D of the California Constitution, as provided for under Section 5(c) of said Article XIII D.

SECTION 3, That the Mayor and Common Council do hereby find and determine
19 that the proportionate costs to be levied against the parcels of land within the Central City
20 parking District No. 947 are correctly set forth on Assessment Roll No. 947, for the fiscal year
21 2001/2002, a copy of which is on file in the office of the City Clerk of said City, and do hereby
22 confirm said assessments.

request that the individual assessments be placed on the subject 2001/2002 property tax bills

SECTION 4. That the City Clerk is directed to cause a copy of this Resolution to be
transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the
C 27 for collection together with all other property taxes.
