Clark, City Clerk February 13, 2001 Ordinance of the Mayor and Common Council of the City of San Bernardino, California, amending section 5.04.500 of the San Bernardino Municipal Code to require registrations for individual vendors at swap meets. BACKGROUND INFORMATION: The Legislative Review Committee met on several occasions to discuss the current language in the Municipal Code in relation to swap meets. Municipal Code Section 5.04.500 requires that a swap meet operator pay a registration fee 0[$500.00 per year. Individual vendors operating at swap meets currently do not pay a registration fee when an admission fee is charged to enter the swap meet. On Thursday, February 8, 2001 the Legislative Review Committee recommended that a proposed orqinance amending Municipal Code Section 5.04.500 be referred to the full Council. \Ihe amendment would require eac~ vendor operating at a swap meet to obtain a business registration, including the operator) These registrations would be good for one year and would permit the vendor to operate at any approved location in the City of San Bernardino. The effect of the amendment would be to level the playing field and require these vendors to register individually as any other business enterprise. FINANCIAL IMPACT: There would be no financial impact because vendors now operating in swap meet type environments are registered individually. Vendors are registered individually because there is no admission fee charged which is a prerequisite to being considered a swap meet. Section 5.04.500 of the San Bernardino Municipal Code is hereby amended in its entirety to now read as follows: 5.04.500 Swap meet. A. For every person, finn or corporation operating, conducting and/or managing a swap meet in the City, the fee is established by resolution of the Mayor and Common Council pursuant to Section 5.04.525F of this Code. B. For every dealer or individual selling or offering for sale goods, wares, merchandise, or things or articles of value at a swap meet in the City, the fee is established by resolution of the Mayor and Common Council pursuant to Section 5.04.525B of this Code. C. For every dealer or individual selling or offering for sale food for human or animal consumption at a swap meet in the City, the fee is established by resolution of the Mayor and Common Council pursuant to Section 5.04.525C of this Code.
