Markets at 161 E. 40th Street. Mayor and Common Council Meeting of February 20, 2001 APPLICANT/OWNER Walter Ford Stater Bros. Markets 21700 Barton Road Colton, CA 92324 909.783.5002 REQUEST AND LOCATION Stater Bros. Markets is building a new grocery store at 161 E. 40th Street to replace its existing market at 277 E. 40th Street and will transfer its existing Type 21 ABC license (off-sale general) to the new store. The new store is approximately 500 feet west of the existing store, within the same census tract boundary. Both stores are located in the CG-l, Commercial General land use district. However, the state Department of Alcoholic Beverage Control is requiring a determination of public convenience or necessity for the license transfer. ENVIRONMENTAL DETERMINATION This request was reviewed in accordance with the California Environmental Quality Act and found to be exempt per Section 15301. POLICE DEPARTMENT RECOMMENDATION The Police Department does not oppose the ABC license transfer. All conditions of approval from the current license will be applicable. DETERMINATION Staff believes that a determination of public convenience or necessity can be met. The sale of alcoholic beverages for off-site consumption is a service typically found at all large grocery stores. FINANCIAL IMPACT None. The applicant submitted the applicable processing fee. STAFF RECOMMENDATION Staff recommends that the Mayor and Common Council determine that the public convenience or necessity is served and direct the Planning Division to prepare a letter for the Department of Alcoholic Beverage Control for a Type 21 liquor license at 161 E. 40th Street.
