Backl!round: On October 2, 2000 the Mayor and Common Council awarded a contract to Earth Tech, Tyco International LTD company, for professional environmental inspection services for removal of hazardous materials at the San Bernardino Santa Fe Depot. On December 4, 2000 the Mayor and Common Council awarded a contract to Janus Corporation to perform abatement of lead based paint, asbestos, PCB, and clean up of the depot. During the bidding process, the City was asked by contractors to verify the estimated quantity of asbestos that was to be removed from the depot. Earth Tech was asked to perform an additional asbestos survey and sampling for an added cost of $3,900.50, this resulted in Change Order No. One, which has been approved by the City Administrator. Contractors also stated that due to the amount of clean up and additional quantity of asbestos to be removed, the work could not be completed within 50 working days as required by the specifications; they requested that the completion time be increased to 150 working days. Staff verified the scope of work with Earth Tech and subsequently, supported an amended time of completion of 120 working days. Modification to the Oril!inal Contract The original contract with Earth Tech was based on 50 working days to complete the project; the amended time of 120 working days will result in an increase not to exceed $41,345.00. If Janus Corporation is able to complete the project sooner than 120 working days, the City's obligation to Earth Tech will be for the actual time they spend inspecting the work. -2- Staff Reoort Subiect: Authorization to execute Contract Change Order No. Two to the contract with Earth Tech. Financial ImDact: All costs incurred for this project are charged to Account No. 123-558-5504-7178 (Restoration of the San Bernardino Santa Fe Depot). The net cost of this change order is $41,345.00. In addition, all costs associated with the Depot rehabilitation are reimbursable through the $1,371,746.00 in federal transportation funds awarded, excepting the local match requirements. The City received $168,926.00 from SANBAG on July 6, 1999 as local match funds for this project. There is approximately 18,000 square feet of 12" spline ceiling tileslmastic to be removed. The majority of these tiles are located in areas that are currently being abated or still need to be abated. In the areas that have already been abated, the contractor should be required to place two layers of 6-mil polyethylene sheeting on all critical barriers and cover the floor with one layer of 6-mil polyethylene sheeting. Negative pressure should be established and the ceiling tiles removed. In the areas which are currently under containment or still need to be abated, the preparation for the materials specified to be removed is sufficient for the additional removal of the 12" spline ceiling tiles/mastic. Janus has 5,000 square feet of spline ceiling tile removal included in their bid. They have expended 2,000 square feet of this and most of the damaged ceiling tiles required to be removed have been removed. The nc:cd for an additional a.'1bestos survey and sampling in the building is based on our review of the report prepared by Converse and a walk of thc site performed by Earth Tech on October 18, 2000. Our review of the survey report prepared by Converse identified incoDllist.encies in the sampling of some of the materials. Additionally. some of the materials were not sampled in accordance with the CaI-OSHA requirements. During the walk of the building on October 18, 2000, Earth Tech identifIed approximately four times as much asbestos-containing Ooor liIe as ill included in the specificatioDll. Bused on this, it is our recommendation that additional asbestos survey and sampling activities be performed to minimize change orders hy the abatement contractors. The survey will be reslricted to the interior of the building a~ the exterior of the building and the roof have been excluded from the abatement project. Seope of Work 1. Earth Tech will provide a California Certified Asbestos Consultant and Site Surveillance Technician to perform additional asbestos survey and sampling activities al the site. lbe survey and sampling will be limited 10 flooring IIllIterials, pipe iDlIu1ation, and damaged ceiling materials. 2.
