Backl!:round: On June 19, 2000, the Mayor and Common Council awarded a contract to Pyramid Building & Construction for the Installation of a Wall along Mountain Avenue between 39th Street and 40th Street. The purpose of this project was to replace an existing sandbag wall that was installed along the West Side of Mountain Avenue between 39tthStreet and 40th Street during the late 1970's as an emergency measure to protect adjacent residential properties from being flooded during major storms. The sandbag wall was later gunited and was left in place as a flood protection device. The wall had begun to crack due to age and had generally exceeded its life expectancy. Many citizens complained that the sandbag wall detracted from the beauty of the neighborhood. During construction it became apparent that certain changes to the contract were necessary to provide a product acceptable to the local residents. The previously approved Contract Change Order (CCO) #1 and the proposed CCO #2 are described below. CCO #1 was approved by the Interim Director of Development Services. That change order, in the amount of $1,750.00, compensated the contractor for removal of seven (7) additional trees which was necessary to construct the wall. As described in the attached change order, CCO #2 resulted in significant changes to the original project design. These changes were the result of a neighborhood meeting held in October of 2000, involving the residents, the Mayor's Office, Staff, and the Council Office which was held to address neighborhood concerns that had arisen after the construction began. As a result of the meeting, the plan was modified to delete the curb & gutter, sidewalk, and the Type "A" curb (modified) with handrail, and replace it with a 6" thick, solid grouted, 6 foot high masonry wall. At this point, the old sandbag wall had already been removed and, with winter approaching, the residential properties along the west side of Mountain A venue could potentially have been exposed to flooding if a major storm occurred. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report - continued In order to protect the property owners from flooding and potential liability on the part of the City, Staff directed the contractor to proceed with the proposed construction of a 6-foot high block wall that was acceptable to all involved. Due to cost considerations and objections by some of the neighbors, the sidewalk was deleted from the project. As a further complication to the project, Southern California Edison Company (SCE), at the request of the Public Services Department, removed 10 large Palm trees along the west side of Mountain A venue at no cost to the City. These trees were damaging overhead power lines and creating a potentially dangerous situation. In addition, Staff consulted with neighborhood representatives who ultimately agreed with the decision to remove the Palm trees. Unfortunately, SCE's contractor left holes approximately 10 feet in diameter and 14 feet deep at each of the 10 locations where Palm trees were removed. Given that SCE was under no obligation to remove the Palm trees, and in fact would have preferred to keep trimming them indefinitely, the trees were removed at the City's request and SCE felt no obligation to re- compact the holes in preparation for the wall construction. Therefore, it was necessary to authorize Pyramid Builders to proceed on a time and materials (T &M) basis to fill the holes prior to start of construction of the 6-foot concrete block wall. Please see the attached Change Order for further details of this Change Order No. Two MODIFICATIONS TO THE ORIGINAL BID Due to modifications to the character of the project, certain items in the original bid were reduced in quantity or deleted entirely. These modifications have resulted in a reduction in contract cost of approximately $69,575.29. Davs from re-start CITY OF SAN BERNARDINO - REOUEST FOR COUNCIL ACTION Staff Report - continued Financial ImDact: All costs incurred for this project are chargeable to Account No. 129-367-5504-7157 (Mountain Ave. South of 40111 St. - Remove Sandbag wall and replace with barrier). The net cost of this change order in the amount of $40,952.94 plus the amount of CCO #1 of $1,750.00 equals a net increase in the contract amount of $42,702.94. This net amount exceeds the contingency amount of $13,989.37 which was approved by the Mayor and Common Council as part of the contract award. Therefore, we are recommending the transfer of $29,000 from Account No. 129-367-5504-7156 "Street ImprovementslSafety Improvements _ Citywide" to Account No. 129-367-5504-7157 (Mountain Ave. South of 40111 St. - Remove Sandbag wall and replace with barrier) which will cover that amount exceeding contingencies and additional inspection costs incurred due to the changes. Recommendation: 1. ($ 69,575.29) NET ADDED COST DUE TO THIS CHANGE ORDER $ 40,952.94 JUSTIFICA nON: Item 1: The original design of this project called for an 8 inch curb & gutter, a 5 foot wide sidewalk, and ai' -6" high Type "A" curb with a handrail on top to replace a gunited sandbag wall which was constructed in the 1970's as a flood protection measure. After construction began, residents adjacent to the project raised objection to the removal of a number of trees along the west side of Mountain between 39th Street and 40th Street. A handful of Olive trees and several Palm trees had already been removed at the time the neighborhood complaints began. A neighborhood meeting, involving the residents, the Mayor's Office, Staff, and the Council Office, was held to address the concerns. As a result of the meeting, the plan was modified to delete the curb & gutter, sidewalk, and the Type "A" curb (modified) with handrail, and replace it with a 6" thick, solid grouted, 6 foot high masonry wall. See attached contractor proposal to perform this work. Item 2: Although there were initial objections to removal of any of the trees along the west side of Mountain Avenue, it was found during the neighborhood meeting, that the majority of residents were not concerned about the removal of the Palm trees. The Palms were regarded as a nuisance due to falling fronds and rat nests. Additionally, the trees had been severely "topped" by Southern California Edison Company due to interference with overhead power lines. Further, the City's Public Services Department voiced concern that the Palms would be difficult to maintain after the 6 foot high wall was built. Because of that concern Public Services Department authorized Southern California Edison to completez remove a total of ten additional Palm trees along the west side of Mountain Avenue between 39 Street and 40th Street. CCO #2 Pyramid Builders Page 3 of 4 Because ofthe tree removal, 10 holes approximately 10 feet wide by 14 feet deep were left along the west edge of Mountain A venue in the same alignment as the proposed 6 foot high masonry wall. Southern California Edison's landscape contractor who removed the trees was unable to properly backfill and compact the holes and, instead, just pushed the excavated material back into the holes. Therefore, it was necessary for the City to authorize Pyramid Builders to re- excavate the holes and properly backfill and compact the material in accordance with Public Works Standard Specifications. Due to the uncertainty of the amount of work involved, the contractor agreed to perform the work on a time and materials basis in accordance with Section 3-3 "Extra Work" of the Standard Specifications. See attached time and materials (T&M) report for the period October 31, 2000 through December 8, 2000. Item 3: The original bid included an item for 20 tons of Asphalt Concrete Pavement at $191.00 per ton. This item was intended to compensate the contractor for patching the pavement around the proposed new curb and gutter. Due to the change in design to a 6 foot high block wall with no curb and gutter and the requirement to replace additional pavement due to the removal of the Palm trees (see Item 2), the quantity of Asphalt Concrete Pavement increased from 20 tons to 154.8 tons. Under the provisions of Section 3-2.2.1 of the Standard Specifications, increases or decreases in excess of 25% of the original bid quantity require a change order and is subject to an adjustment in the unit price. Due to the substantially increased quantity of Asphalt Concrete Pavement and the change in character of the work required to install the pavement, the contractor agreed to decrease the unit price from $191.00 per ton to $90.00 per ton. Staff feels this is a fair and reasonable price for the extra work necessary to supply and install the Asphalt Concrete Pavement for the revised design.
