STAFF REPORT
The Cable Creek Channel is under the jurisdiction of the
California Department of Fish and Game (CDFG), therefore, a
streambed alteration agreement must be executed with CDFG to
authorize the work in the channel.
The attached agreement was prepared by CDFG and contains
the terms and conditions under which the City will be authorized
to construct the box culvert at Little League Drive.
This agreement is CDFG's standard form. We do not anti-
cipate any problems complying with the conditions therein and,
therefore, we recommend that it be approved.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING
THE EXECUTION OF STREAMBED ALTERATION AGREEMENT NO. 5-544-92
WITH THE CALIFORNIA DEPARTMENT OF FISH AND GAME RELATING TO
CONSTRUCTION OF A BOX CULVERT ON LITTLE LEAGUE DRIVE AT CABLE
CREEK CHANNEL.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION ONE: The Mayor of the City of San Bernardino
is hereby authorized and directed to execute, in behalf of said
City,
Streambed Alteration Agreement No. 5-544-92 with the
California Department of Fish and Game for the construction of
a Box Culvert on Little League Drive, a copy of which agreement
is attached hereto, marked Exhibit "A," and incorporated herein
by reference as fully as though set forth at length herein.
SECTION TWO: The agreement shall not take effect until
fully signed and executed by all parties. The City shall not be
obligated hereunder unless and until the agreement is fully
executed and no oral agreement relating thereto shall be
implied or authorized.
SECTION THREE: The authorization to execute the above-
referenced agreement is rescinded if the parties to the
agreement fail to execute it within sixty (60) days of the
passage of this resolution.
