STAFF REPORT
Bids for the construction of a box culvert on Little
League Drive, at Cable Creek Channel, were opened at 2:00 p.m.,
Tuesday, 9-8-92.
A total of 12 bids were received, ranging from $296,134.15
to $478,070.00. The low .bid of $296,134.15 is 9.2% under the
Engineer's Estimate of $328,277.08.
Below is an estimate of the total project cost, based upon
the actual low bid price.

An amount of $710,000 has been allocated, under Account
No. 242-362-57471, in the Street Construction Fund, to finance
the costs incurred for this project. Federal Bridge Replacement
Funds will be provided to finance 80% of the costs.
We recommend that a contract be awarded to the low bidder.
URGENCY CLAUSE ~
It is necessar" for a contract to be awarded at the Council
Meeting of 9-:21"92, in order for the construction to be
substantially completed prior to the major rain storms that
normally occur in January and February.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO BOB BRITTON, INC. FOR CONSTRUCTION OF A BOX CULVERT
3 ON LITTLE LEAGUE DRIVE, AT CABLE CREEK CHANNEL.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. Bob Britton, Inc. is the lowest responsible
bidder
for: Construction of a Box Culvert on Little League
Drive,
at Cable Creek Channel, per Plan No. 8442. A contract is
awarded
accordingly to said bidder for the total amount of
$269,134.15, but such award shall be effective only upon the
contract being fully executed by both parties. All other bids,
therefore, are hereby rej ected.
The Mayor is hereby authorized
and directed to execute said contract on behalf of the City; a
copy of the contract is on file in the office of the City Clerk
and incorporated herein by reference as fully as though set forth
at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
