REQUEST QR COUNCIL ACTION STAFF REPORT The city is present1y in the process of imp1e~enting a Mobi1e Data System and needs to obtain the services of a qualified consu1tant with expertise in this high1y technical field to act as Mobile Data Systems Project Manager and guide the process to a successful completion. Mr. Kenyon D. Crabtree of The Communications Group has these qualifications. Mr. Crabtree has served in this capacity for a simi1ar project inv01ving the cities of Ontario, Montc1air and Chino and was high1y recommended. His duties wi1l inc1ude coordinating all aspects of the insta1lation project with Motorola, obtaining the necessary FCC 1icenses, deve10ping a time1ine and estab1ishing critica1 mi1estones in concert with Motor01a, the County of San Bernardino, PRC and Tiberon (software vendors) and the city's MIS Division, coordinating microwave interconnects and hardware equipment insta1lations on Litt1e Mountain, Jurupa and Sunset Mountain sites. He will a1so provide training to City staff throughout the project's phases to accomplish successfu1 implementation of the mobi1e data system. Mr. Crabtree wi11 be reimbursed on an hourly basis for his services at a not-to-exceed amount of $37,700. The 1ength of the contract is anticipated to be one year and wi1l terminate upon final City acceptance of the MDT system. RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE BXECUTION OF AN AGREBMENT BY AND BBTWEEN THE CITY OF SAN BBRNARDINO AND KENYON D. CRABTREB, CONSULTANT, DOING BUSINESS AS THE COMMUNICATIONS GROUP, FOR SERVICES RELATING TO MOBILE DATA SYSTEKS PROJECT MANAGER SERVICES. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor is hereby authorized and directed to execute on beha1f of the City an agreement by and between the City of San Bernardino and Kenyon D. Crabtree, Consultant, doing business as the Communications Group, for services in connection with imp1ementation of the City's Mobile Data Systems Project. SECTION 2. The authorization to execute the above-referenced agreement is rescinded if the parties to the agreement fail to execute it within sixty (60) days of the passage of this resolution. CRABTREE, doing business as The 6 Communications Group ("Consultant"): 7 WITNESSETH 8 WHEREAS, the city is in the process of implementing a Mobile 9 Data System: and 10 WHEREAS, the services of a qualified consultant is needed to 11 act as Mobile Data Systems Project Manager to assist in the process 12 of imp1ementing a mobi1e data system: 13 NOW, THEREFORE, the parties hereto agree as follows: 14 1. Consu1tant agrees to: 15 a. Develop a timeline and establish critical 16 paths and milestones in concert with Motorola 17 Project Management for full Data System 18 Implementation. 19 b. Work in concert with San Bernardino County 800 20 MHz Communications Group to coordinate 21 time1ine staging, installation, and 22 interconnection to County microwave services 23 at Litt1e Mountain, Jurupa, and Sunset radio 24 sites. 25 c. Review and approve acceptance test plans and installation quality checklists for site insta1lations, system functiona1ity and coverage guarantees. Interface with Motorola Data Division, PRC and City's Management Information Systems to develop and implement the CAD-Host Interfaces. Work with City, Motorola, County of San Bernardino and other vendors and participating agencies to establish and maintain a suitab1e pace of work on the project. Coordinate and attend meetings(s) between City officials, projects persons, interested agencies and vendors. Develop reports to project consultant (Omnicom, Inc.) identifying project status and adherence to milestones. Provide periodic reporting of progress on project to city (period and method to be determined. ) Deve10p an "After Action Report" at the completion of the project, identifying project implementation history, fina1 status, and e. f. g. -2- . f r --. Provide for training of city staff re1ative to 4 Mobile Data System implementation. 5 2. city shal1 compensate consu1tant at the rate of $92 per 6 hour payab1e month1y upon receipt of a statement from consultant 7 describing work performed that month for a tota1 amount not to 8 exceed Thirty seven thousand six hundred dol1ars ($37,600). 9 3. The term of this agreement is from August 18, 1992 up to 10 and including August 18, 1993. This agreement may be extended on 11 a month-to-month basis for a maximum of twelve (12) additional 12 months upon written consent of the consu1tant to said extension and 13 the approval thereof of the city Administrator. Either party may 14 terminate this agreement for any reason upon fifteen (15) days 15 written notice to the other. 16 4. For a11 purposes of this Agreement, consu1tant shall be 17 an independent contractor and shall not be considered as an 18 emp10yee of the City. 19 5. Consultant agrees to defend, indemnify, save and hold 20 City, its-officers, agents and employees harmless from any claim or 21 suits that may be brought by third persons on account of personal 22 injury, death, or damage to property, or a property or business or 23 personal interest, arising from any negligent act or omission by 24 consultant while performing service under this agreement. 25 6. This agreement shall be governed by the laws of the State of California. It constitutes the entire Agreement between 9 parties regarding its subject matter.
