STAFF REPORT
Complaints were received by this, Department, after inspections
by Vehicle Abatement Officers, 1ega1 ten (10) day notices were
issued and mailed to 1and owners. Upon no response to the Abatement
Orders, the abandoned vehic1es were abated by the City. Costs were
incurred by the city for abatement and are being liened on the
properties.

RESOLUTION
2 RESOLUTION OF THE CITY OF SAN BERNARDINO ASSESSING CERTAIN
PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO
3 FOR THE COSTS OF ABATEMENT OF PUBLIC NUISANCES (ABANDONED VEHICLES)
ON SAID PROPERTIES.

1IBEREAS, the city of San Bernardino, pursuant to its authority
under Chapter 8.36 of the San Bernardino Municipal Code,

did 1awfully give notice of and' thereafter abate public nuisances
7
found to exist on the properties 1isted be10w; and

1IBEREAS, pursuant to the San Bernardino Municipal Code, the
Director of Facilities Management Department served notice on a11
10
property owners of the abatement costs for removing abandoned,
11
wrecked, dismantled, and/or inoperable vehic1es or parts thereof
12
from the property; and
13

1IBEREAS, opportunity for a hearing of the Board of Bui1ding
Commissioners to protest the abatement costs was afforded the
15
property owners, with no response forthcoming;

NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor and Common Council confirm and adopt
as speci~l assessments, the following abatement costs which have

been incurred by the City for the abatement of public nuisances

found to exist on the following properties;

PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO
FOR THE COSTS OF ABATEMENT OF PUBLIC NUISANCES (ABANDONED
3 VEHICLES) ON SAID PROPERTIES.

4 SECTION 2. The above assessments shall be paid to Pacilities
5 llaDaq_ent Department, basement of city Hall, 300 No."D" Street,
6 San Bernardino, CA 92418, withi~ thirty (30) days after notice of
7
this resolution is mai1ed to a1l parties with an interest in the
8 above properties. A11 assessments not fully paid in thirty (30)
9 days sha11 become a 1ien on the property pursuant to The San
10 Bernardino Municipal Code and shall be c011ected as a specia1
11 assessment thereon.
12 SECTION 3. If the above assessment is not paid as hereinabove
13 provided, the City C1erk is directed to file a certified copy of
14 this resolution with the Auditor of the County of San Bernardino,
15 State of California, directing that said assessment be entered as
16 a 1ien against the property as it appears on the current assessment
17 rolls. The assessment sha11 be col1ected at the same time and in
18 the same manner as the genera1 property taxes for the City of San
19 Bernardino inc1uding pena1ties and interest for delinquent
20 payments.
