advertise for bids.

STAFF REPORT
Bids for this project were opened at 2:00 p.m., Tuesday,
8-11-92.
A tota1 of 7 bids were received, ranging from $15,824.50
to $32,650.00. The low bid of $15,824.50 is 16.6% below the
Engineer's Estimate of $18,976.00.
Below is the total estimated project cost, based on the
actual low bid price:

An amount of $20,000 was a11ocated, under Account No. 245-
365-57705, in the 1990/91 Sewer Line Construction Fund Budget to
finance the costs incurred for this project. The transfer of
$5,000 in supplemental funds was approved at the Council meeting
of 7-6-92, for a total available amount of $25,000.00.
We recommend that a contract be awarded to the low bidder.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO WEST STAR UNDERGROUND, INC. FOR INSTALLATION OF SEWER
3 IN SEPULVEDA AVENUE, NORTH OF 50TH STREET.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1.
West Star Underground, Inc, is the lowest
responsib1e bidder for:
Installation of Sewer in Sepulveda
north of 50th Street, per Plan No. 8745.
Avenue,
A contract is
awarded accordingly to said bidder for the total amount of
$15,824.50, but such award shall be effective only upon the
contract being fully executed by both parties. All other bids,
therefore, are hereby rej ected. The Mayor is hereby authorized
and directed to execute said contract on behalf of the CitYl a
copy of the contract is on file in the office of the City Clerk
and incorporated herein by reference as fully as though set forth
at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
