June, 1990 - Allocation of $75,000.00 in the 1990/92 Street Con-
struction Fund Budget into Acct. 242-362-57387.
04-06-90 Resolution 92-114 adopted authorizing execution of a
Cooperative Agreement with'the State of California for
funding.

STAFF REPORT
Bids for this project were opened at 2: 00 p.m., Tuesda~,
8-18-92.
A total of 13 bids were received, ranging from $59,843.00
to $87,100.00. The low bid of $59,843.00 is 20.2% below the
Engineer's Estimate of $75,000.00.
Below is the total estimated project cost, based upon the
actual low bid price:

The Cooperative Agreement with the State of California
provides that the cost incurred for this project will be borne
equally by the State and City. Each agency's share will,
therefore, be $40,250.00. The City's share will be financed by
the $22,500.00 paid by two adjoining developments and $18,750.00
by The Home Depot.
We recommend that a contract be awarded to the low bidder.

RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO PAUL GARDNER CORPORATION FOR MODIFICATION OF T~FIC
3 SIGNALS AND HIGHWAY LIGHTING AT HIGHLAND AVENUE AND LINCOLN
DRIVE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION
1.
Paul
Gardner
Corporation
is
the
lowest
responsible
bidder
for:
Modification of Traffic
Signals and
Highway Lighting at Highland Avenue and Lincoln Drive, per Plan
No.
8564.
A contract is awarded accordingly to said bidder for
10 the total amount of $59,843;00, but such award shall be effective
11 only upon the contract being fully executed by both parties. All
12 other bids, therefore, are hereby rejected. The Mayor is hereby
13 authorized and directed to execute said contract on behalf of the
14 City; a copy of the contract is on file in the office of the City
15 Clerk and incorporated herein by reference as fully as though set
16 forth at length.
17 SECTION 2. This contract and any amendment or modifica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements, amendments, modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.

SECTION 3. This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.
