Mayor and Common Council Meeting of August 17, 1992 REOtJEST The appellant, Barbara L. Sky, is appealing the approval of Tentative Tract No. 14997 by the Planning Commission. The appellant requests that the Mayor and Common Council reevaluate the approval of the residential sUbdivision. The Council, acting on Commission approval of following action: Barbara Sky's appeal of the Planning Tentative Tract No. 14997, took the That the appeal be continued for thirty days to August 17, 1992 to proceed with the code enforcement investigation and violation issuance: and if the drive-way is not installed in thirty days, by August 17, 1992, the Council may deny approval of the Tentative Tract. On August 5, 1992, the Public Works Department issued a permit to Robert Stone for the construction of the required drive-way for 3075 Belmont Avenue. The construction of the drive-way is in progress. Mayor and Common Council Meeting of July 20, 1992 REOUEST The appellant, Barbara L. Sky, is appealing the approval of Tentative Tract No. 14997 by the Planning Commission. The appellant requests that the Mayor and Common Council reevaluate the approval of the residential subdivision. BACKGROUND Tentative Tract No. 14997 is a proposal to subdivide 3.13 acres into ten (10) single-family lots with a density of 3.18 dwelling units per gross acre in an area designated by the General Plan as RL, Residential Low. On May 19, 1992, the Planning Commission held a properly noticed public hearing on Tentative Tract No. 14997. During the pUblic hearing, Gary Hartzell, a planner for Sierra Engineering spoke in support of the project on behalf of the applicant, Robert Stone. Barbara L. Sky, an adjacent homeowner to the proposed tract, presented testimony for the hearing. She stated that she was not against the subdivision in principle, but rather felt that the applicant, Robert Stone was being shown favoritism due to his role as a Planning Commissioner. She provided documentation of a previous building permit allegedly incorrectly finaled and she recommended that the applicant should be required to bring the property up to existing Municipal (Development) Code standards prior to initiating additional development (see Exhibit "4", Attachment "A"). After Ms. Sky's testimony, the public hearing was closed. t"." C (II'''' .~"I ("'" ,.,,1 o o Tentative Tract No. 14997 (Appeal) Mayor and Common Council Meeting July 20, 1992 Page 2 Prior to discussion amongst the Commissioners, Henry Empeno, Deputy City Attorney, instructed the voting Commissioners that the item before them was the subdivision of the land and not the Municipal Code violations that mayor may not exist at the subject property. A motion was made for subdivision approval, the motion was seconded, and then was carried by unanimous vote of the six eligible Commissioners in attendance with Commissioner stone abstaining from the hearing. On June 1, 1992, Ms. Barbara L. Sky, submitted an appeal of the Planning Commission's decision of approval (see Exhibit "1"). The basis for her appeal is that the Planning Commission did not take into account all available and pertinent information about the property and existing structures prior to making their decision. ANALYSrS The City Attorney's Office along with Planning and Building Services and Public Works Departments discussed the appeal in a meeting held on June 5, 1992, the outcome of the meeting is contained within Exhibit "2". The determination made at the meeting was that no City agency was given the authority to waive Municipal Code provisions and that the property in question would be required to meet minimum standards. As a result, the Planning and Building Services Department has initiated the processing of a Notice of Violation for the current property owner at 3075 Belmont Avenue to comply with the residential access provisions in the Municipal Code. Under the Notice of Violation provisions, the property owner will be notified of the Municipal Code violation and then will have 180 days to complete the required improvements to meet current Municipal (Development) Code standards. If after 180 days, the improvements are not completed then the owner will be open to criminal charges with the filing of the citation. ADDITIONAL CONDITIONS MUST BE PUT ON THIS TRACT ADDRESSING A TIME LIMITATION FOR CONSTRUCTION TO START, AND EITHER THE STREET OR THE DRIVEWAY MUST BE IN PLACE. I FEEL THIS IS OPENING UP THE CITY TO LAWSUITS, AND I RESENT THAT FACT, BECAUSE IN THE END, IT'S THE CITIZENS w~O END UP PAYING FOR THE CITY'S MISTAKES. This discussion focused on two issues. They were: 1. Under what authority did Public Works Department (City staff) administratively waive a Municipal Code provision? 2. Can the City impose additional conditions of approval to a tentative tract after the Planning Commission approval? The followinq is the resul.t of the discussion of these two issues: In response to Issue Number One (1), there is no administrative authority to waive Municipal Code requirement for the installation of a required driv_ay. The efforts by city staff to work with you to resolve the driveway issue was not a waiver, but only an indication that the City would not pursue prosecution and/or require the house to be vacated while you were seeking an alternative way (an approved Subdivision and related public street) for resolving the driveway issue. This agreement to not prosecute or require vacation of the house was not an open ended way of avoidinq the construction of the required driveway. Therefore, if your Subdivision is approved (as an alternative to construction of ..the driveway), it would be appropriate for the City to direct you to either install the drive, remove the house, or build a subdivision street within a reasonable period of time. When the condition is agreed to by the tentative tract applicant and land owner. b. When the condition is imposed by the Mayor and Council as part of the tentative tract approval being appealed to the Mayor and Council. Additionally, discussion centered around what were and are the City's driveway construction standards. The Code in 1986 stated: "J.9.56.010 Parking Space Requirements D. Access shall be provided by means of a paved driveway which should be not less than J.5 feet wide for a one-way dr~ve and not less than 24 feet wide for a two-way drive." "J.9.56.380 Asphaltic Concrete Surfacing or Paving All areas shall be surfaced or paved with asphaltic concrete, concrete, or other bitulithic surfacinq acceptable to the Commission and thereafter be maintained in good condition." Based upon the foregoing section, in 1986, the drive should have been 24-feet wide and constructed of the appropriate thickness of asphalt or concrete for a distance of 380 feet from Bel.lllont to the house. The City's current standards are from the city's Development Code and Fire Code. A. DEVELOPMENT CODE Standards" .section J.9.24.060" Design 5. An appropriate structural section of slag or other material may be approved by the City Engineer and Director =or storage area of industrial uses, provided that toxic or 'hazardous materials,...are not located in such storage areas.- B. -Fire Code Section 10.207 (b) Where Required Fire apparatus, access road shall be required for every building hereafter constructed when any portion of exterior wall of the first story is located more than 150 feet from Fire Department vehicle access (public road). (c) Width The unobstructed width of a fire apparatus road shall be not less than 20 feet. (f) Surface Fire apparatus access road shall be designed and maintained to support the imposed loads of fire apparatus and shall be provided with a surface so as to provide all weather driving capabilities.- The current codes could be interpreted to allow a driveway 20 feet wide constructed with a minimum of 6 inches of compacted crushed rock with an approved bituminous surface treatment/sealant for approximately 380 feet frOlD Belmont Avenue to the house identified as 3045 Belmont Avenue. Based upon the above information, would you be agreeable to adding a condition to your tentative tract that, within six months of tentative tract approval, you would construct a driveway meeting current city standards or construct the street as shown on your approved tentative tract. The Planning commission granted a one-month continuance to its May 19, 1992 meeting for Tentative Tract No. 14997, a request to subdivide 3.13 acres into ten (10) single- family lots in an area designated by the General Plan as RL, Residential Low. ("'" '.,,1 On April 20, 1992, Planning staff received a six page letter from an adjacent homeowner who questioned whether favoritism was being shown to the applicant, Robert Stone (see Attachment "A"). The letter details a series of violations that have allegedly occurred on the Stone's property. The homeowner is questioning whether the subdivision should be approved given that there appears to be outstanding code violations. On a separate issue, the adjacent homeowner called Planning staff after reading the staff report prepared for the April 21, 1992 meeting to inquire about the proposed wall which is to separate the subject property from their land. During the December 5, 1991, Development Review Committee public meeting, the homeowner requested that a solid decorative block wall be constructed along ,the eastern perimeter of the subject property to separate the higher density RL, Residential Low subject site from the lower density RE, Residential Estate properties to the east. At the time, the owner/applicant agreed to provide the solid screening. At a previous meeting, the Police Department indicated that they would prefer a wall that provided some visibility to the rear yards for security and safety purposes. fl!' ~...." The first issue is whether or not the subdivision can be approved and the second issue involves the design details of the perimeter wall. The subdivision as proposed does not make allowances for the retention of the two existing homes in their present locations. Two Conditions of Approval were written to address the existing above-ground and below-ground structures currently on-site. Condition of Approval No. 11 specifies that the owner shall remove the existing septic tanks and all associated substructures completely from the property prior to map recordation. Condition of Approval No. 12 states that the owner shall remove both dwellings and any accessory structures prior to map recordation and that the removal, relocation and/or demolition shall comply with all applicable City standards in effect at the time (see Attachment "B"). The second issue involves the eastern section of the perimeter wall. The homeowner is correct that the recorded tape during the open public meeting section for the December 5, 1991, Development Review Committee meeting includes a statement from the applicant stating that it would be his preference and he would have no problem at all with a solid wall. As a compromise between the Police Department, the applicant, the adjacent homeowner and Development Code standards, Planning staff is proposing that a 6-foot high wall with decorative block and decorative capping be constructed along the eastern property line. The decorative block wall shall be designed with pilasters provided at every change in direction, every 5 foot difference in elevation and at a minimum of every 25 feet of continuous wall. The wall when facing rear yards shall include a minimum of one deco,::-ative porthole (minimum size of 4 inches by 4 inches) for each lot for security (see Attachment "B"). The side yards of lots 1, 5, 6 and 10 forming the perimeter of the subdivision should continue the eastern wall design pattern or select a compatible design. CONCLUSION Tentative Tract No. 14997 meets all of the development standards of the Municipal (Development) Code and is consistent with the General Plan and the Subdivision Map Act. Impacts associated with the development of the project will be mitigated and reduced to a level of insignificance through Conditions of Approval and Standard Requirements. The project was reviewed in conformance with the Municipal (Development) Code provisions. The proposed subdivision was found to be consistent with the Municipal (Development) Code and in conformance with the General Plan as shown in Attachment "A". CALIFORNIA ENVIRONMENTAL OUAT,TTY ACT STATUS The Initial StUdy was prepared by staff and presented to the Environmental Review Committee (ERC) on October 17, 1991. The ERC found that no significant impacts would result from the project and recommended a Negative Declaration be adopted. The Negative Declaration was advertised and available for pub1ic review and comment from October 24, 1991 to November 13, 1991. To date, no comments on the Initial Study have been received. If comments are received referencing this project, they will be presented to the Planning Commission at the April 21, 1992, Planning Commission meeting (see Attachment "E", Initial Study). The first parcelization approved by the Planning Commission on August 5, 1975 was Minor Subdivision No. 309 (MS No. 309). This map permitted the division of one existing parcel at the corner of Palm and Belmont Avenue into two separate lots. The rear parcel which was designated Parcel No. 1 is the property now in question. The second subdivision (Minor Subdivision No. 332) was approved on July 20, 1976. This application granted approval to split Parcel No. 2 of MS No. 309 into two equal parcels which could then front onto Palm Avenue. The most recent subdivision involvinq the subject parcels was in 1979. Minor Subdivision No. 530 permitted the further Subdivision of Parcel No. 1 of MS No. 309 into two lots. The resulting configuration was one rectangular lot consistinq of one acre and a "L" shaped lot comprised of about 2.13 acres. The approval was granted by the Planninq Commission on DeCember 4, 1979. ( ~ I' ...... ( ANALYSIS \ " ' Site Characteristics The project site is roughly rectangular in shape and contains two parcels of land which consist of about 3.13 acres. Each parcel of land is currently occupied by one existinq sinqle-fAmily dwellinq. Each dwellinq is connected to an existinq septic tank with an associated overflow leach field. The proposed lot layout does not accommodate the retention of the two existing dwellinqs, therefore, the dwel1ings shall be removed prior to tract map recordation. The topography of the site is relatively flat and slopes in a southerly direction at a grade of approximately five percent. Vegetation on site consists of a row of ornAmental olive trees near the northern boundary of the site, and some seasonal weeds and other native vegetation. Lot Characteristics ("'" The tentative tract will create ten (10) sinqle-fAmily lots, ranqing in size from 11,400 square feet to 12,340 square feet with a proposed density of 3.18,dwellinq units per gross acre. Trarric The City Traffic Engineer reviewed the proposed subdivision and determined that the project did not meet the minimum criteria for a traffic impact study. The additional trips from the proposed project are not sufficient to cause a significant impact on the adjacent street system. Ace... and Circulation The site has frontage along the south side of Belmont Avenue of approximately 335 feet and is located about 370 feet west of the centerline of Palm Avenue. Tentative Tract No. 14997 proposes to utilize Belmont Avenue as its primary access for all lots. Belmont Avenue is classiried as a collector with a right-of-way of 60 feet. The ten lots will take access to Belmont Avenue by way of an interior street tentatively named "Royal Oak Avenue". The proposed street has been designed to have a temporary turn-around until such time that the property is connected to the parcel to the south. Drainage and .ater/S_er Znrra.tructure The applicant's engineer is proposing to convey the on-site drainage runoff southerly along the proposed street to be intercepted by a future tract to the south and then toward Irvington Avenue. If the future tract at the southern boundary is not in place at the time of development, an alternate method of conveyance will be subject to the review and approval of the Planning and Building Services and Public Works Departments. The design of the tentative tract proposes a 25-foot wide easement for water and sewer through the southerly property in the event that a dedicated street is not in place prior to developing the subject site. The adjacent property owners have furnished Letters of Intent to the City to declare their intent to grant the applicant an easement for sewer, water and drainage purposes. In addition, the owners of the southern property have declared their intent to grant the City dedication for a 50-foot wide roadway for access purposes. A Biological Survey was prepared for the site by Lilburn Corporation on August 29, 1991. The repor:t concluded that no threatened, endangered, or sensitive specJ.es of wildlife or vegetation were found and that none were thought to be present on the subject property. Additionally, a row of ornamental olive trees exists near the northern project boundary. The applicant has indicated that the 12 trees delineated in proposed Lot 1 and the 3 trees in proposed Lot 10 are to remain on-site in their current location. One ornamental tree located in the proposed street right-of-way will be removed with the development of the infrastructure. Kim Burgett, Parks Maintenance Supervisor visited the property for an on-site evaluation and determined that the loss of the single non-native tree would not be considered a significant impact. (" The site is located in a hiqh wind hazard area, Standard Requirements and Conditions of Approval from the Planning and Building Services Department pertaining to building exposure and orientation, and building roof construction using 110 MPH winds shall serve to reduce potential wind impacts to a level of insignificance. The San Bernardino County Museum Archaeological Information Center evaluated the proposed project site and determined that no cultural resources are known to exist within or adjacent to the project area and that the potential for the presence of cultural resources within the project area is low. No further studies were recolDIDended. COMMENTS RECEIVED City Departm_t. All City Departments reviewed the proposal at the Development ,Review COlDIDittee meeting on December 5, 1991. Southern California Gas Company Southern California Gas Company responded to the availability of natural gas service for the project. They indicated that the nearest gas service to the site could be provided from a 6-inch main at the intersection of Belmont and Palm Avenues. u. S. Postmast'8r The Onited States Postal Service requests that the final map shall show easements or other mapped provisions for the placement of centralized mail delivery units. Specific locations for such units shall be to the satisfaction of the Postal Service and the Public Works Department. CONCLUSION Tentative Tract No. 14997 meets all of the development standards of the Municipal (Development) Code and is consistent with the General Plan and the Subdivision Map Act. Impacts associated with the development of the project will be mitigated and reduced to a level of insignificance through Conditions of Approval and Standard Requirements. DISCUSSION OF ENVIRONMENTAL EVALUATION AND MITIGATION MEASURES 1. BAR'1'B RBSOORCBS h. The development of the site could result in soil erosion on or off the property. Proper gradinq and erosion control, including the prevention of sedimentation or damage to off- site property shall be in compliance with the standards outlined in Chapter 15 of the Municipal Code and the Subdivision Map Act Section 66411. 2. AIR RBSOORCBS c. The site is located in a high wind hazard area, Standard Requirements and Conditions of Approval from the Planning and Building Services Department pertaining to building exposure and orientation, and building roof construction using 110 MPH winds shall serve to reduce potential wind impacts to a level of insignificance. 3. WATBR RBSOURCBS a. The nature of the project, i.e. qradinq, construction of streets and driveways, may result in some environmental impacts relating to absorption rates, drainage patterns and. the rate and amount of surface runoff due to the loss of permeable surfaces. The applicant's engineer is proposing to convey the on-site runoff southerly along the proposed street to be intercepted by a future tract to the south and then toward Irvington Avenue. If the future tract at the southern boundary is not in place at the time of development, an alternate method of conveyance will be subject to the review and approval of the Planning and Building Services and Public Works Departments. 4. BIOLOGICAL RBSOORCBS a. The site is located in the Biological Resources Management OVerlay. A Biological Survey was prepared for the site by Lilburn Corporation on AUgust 29, 1991. The report concluded that no threatened, endangered, or sensitive species of wildlife or vegetation were found and that none were thought to be present on the subject property. . d. A row of ornamental olive trees exists near the northern project boundary. The applicant has indicated that the 12 trees delineated in proposed Lot 1 and the 3 trees in proposed Lot 10 are to remain on-site in their current location. One ornamental tree located in the proposed street riqht-of-way will be removed with the development of the infrastructure. Kim Burqet, Parks Maintenance Supervisor visited the property for an on-site evaluation and determined that the loss of the sinqle non-native tree would not be considered a significant impact. The developer shall comply with the regulations outlined in the Uniform Plumbing Code Chapter 11, Section 1119 - Abandoned Sewers and Sewage Disposal Facilities if the development of the site does not impact their present 10cations. The developer shall fill all abandoned facilities within 30 days from the time of connecting to the public sewer. Based on the design of the subdivision, it appears that it is not feasible to plug or cap the existing septic tanks in their present locations rather they will need to be removed completely from the property in conformance with all applicable standards and subject to the appropriate permits and approvals. 13. CULTURAL RESOURCES a. The site lies within an archaeologically sensitive area. The San Bernardino County Museum Archaeological Information Center evaluated the proposed project site and determined that no cultural resources are known to exist within or adjacent to the project area and that the potential for the presence of cultural resources within the project area is low.
