Synopsis of Previous Council action:
On June 16, 1992 the Planning Commission recommended adoption of
the proposed Negative Declaration and approval of the Ordinance.
On February 3, 1992 the Mayor and COl,""on Council directed staff
to prepare a Development Code Amendment to allow miscellaneous
indoor and outdoor recreational uses in the Commercial Heavy
land use district.
Recommended motion:
That the hearing be closed, that the Mayor and Common Council adopt the
Negative Declaration; and further reading of the ordinance be waived and
it be laid over for final adoption.

REOUEST
The request is for an amendment to Development Code Section
19.06.020, Table 06.01 COMMERCIAL AND INDUSTRIAL DISTRICTS LIST OF
PERMITTED USES, to permit miscellaneous indoor recreational uses in
the CH, commercial Heavy land use designation/zone with a
Development Permit, and outdoor recreational uses in the same
district/zone with a ConditiQnal Use Permit.
BACKGROUND
When the General Plan was adopted, property on West Foothill
Boulevard was designated CH, Commercial Heavy on the Land Use Map.
Subsequent to the adoption of the General Plan, but prior to the
adoption of the Development Code, a conditional use permit for a
go-cart track was approved for the site. When the Development Code
was adopted, miscellaneous indoor and outdoor recreational uses
were inadvertently left off the Table of Permissible Uses in the
Commercial Heavy Designation. Due to this omission, the owner of
the go-cart track is unable to intensify the use at his
recreational facility. In order to consider any requests a
Development Code Amendment to allow miscellaneous indoor and
outdoor recreational uses in the Commercial Heavy district is
necessary.
These points were brought to the attention of the Mayor and Common
Council at their meeting of February 3, 1992. As a result, the
Mayor and Common Council directed staff to prepare a Development
Code Amendment to allow miscellaneous indoor and outdoor
recreational uses in the Commercial Heavy land use district.
CALIFORNIA ENVIRONMENTAL OUALITY ACT (CEOAl STATUS
An Initial Study was prepared and presented to the Environmental
Review Committee (ERC) on May 7, 1992. The ERC proposed a Negative
Declaration (See Initial Study, Attachment B of the Planning
Commission Staff Report). The Initial Study was made available for
public review and comment from May 14, 1992 to June 3, 1992. No
comments were received.

ANALYSIS
GENERAL PLAN CONSISTENCY
The proposed amendment is consistent with the with General Plan
Objective 1.30 and Policy 1.30.10 whose intent is to provide for
the development of projects requiring extensive use of ~ndoor or
outdoor space in the CH land use designation. The proposed
amendment will further implement: the policy and objective by
establishing a means by which recreational uses which require
substantial outdoor or indoor space can be established in the CH
land use district.
DEVELOPMENT CODE AMENDMENT
Table 06.01, COMMERCIAL AND INDUSTRIAL DISTRICTS LIST OF PERMITTED
USES, permits miscellaneous indoor recreational facilities in the
Commercial Zones in which it is allowed, subject to the approval of
a Development Permit. Likewise, the table permits miscellaneous
outdoor recreational facilities in the Commercial Zones in which it
is allowed, subject to the approval of a Conditional Use Permit.
The proposed amendment would revise Table 06.01 to permit
miscellaneous indoor recreational facilities with the approval of
a Development Permit, and miscellaneous outdoor recreational
facilities with the approval of a Conditional use Permit in the CH
land use zoning districts.
CONCLUSION
The proposed amendment to Section 19.06.020, Table 06.01 will
permit miscellaneous indoor recreational uses in the Commercial
Heavy land use zoning district, City-wide, subject to the approval
of a Development Permit, and miscellaneous outdoor recreational
uses in the Commercial Heavy zone subj ect to the approval of a
Conditional Use Permit. The amendment is consistent with the
General Plan in that it establishes a means to allow miscellaneous
indoor and outdoor recreational uses requiring extensive indoor or
outdoor space in the Commercial Heavy land use designation, further
implementing General Plan Objective 1.30 and General Plan Policy
1.30.10.
PLANNING COMMISSION
On June 16, 1992, the Planning Commission reviewed the proposed
ordinance and recommended that the Mayor and Common Council adopt
the Negative Declaration and approve Development Code Amendment No.
92-03.

RECOMMENDATION
It is recommended that the Mayor and Common council adopt the
Negative Declaration and approve Development Code Amendment No. 92-
03 based on the attached Findings of Fact (Attachment "A" of the
Planning commission Staff Report).

Declaration was proposed. The Initial Study was made available f.or
public review and comment from May 14, 1992 to June 3, 1992. As of
the writing of this staff report, no comments had been received.

The Development Code Table of Permissible Uses allows miscellaneous
indoor recreational facilities *ith the approval of a Development
Permit in the Commercial Zones in which it is permitted, and
miscellaneous outdoor recreational facilities with the approval of
a Condi tional Use Permit in the same commercial zones. The
Development Code Amendment would revise the Table of Permissible
Uses to allow miscellaneous indoor recreational facilities with the
approval of a Development Permit and miscellaneous outdoor
recreational facilities with the approval of a Conditional ,Use
Permit in the Commercial Heavy land use zoning districts (See
Attachment "B".)
CONCLUSION

Introduction
This Initial study is provided by the City of San Bernardino for
Development Code Amendment No. 92-03. It contains an evaluation of
potential adverse impacts that can occur if the amendment is
adopted and implemented.
The California Environmental Quality Act (CEQA) requires the
preparation of an Initi~l S~udy when a proposal must obtain
discretionary approval from a governmental agency and is not exempt
from CEQA. The purpose of the Initial Study is to determine
whether or not a ?roposal, not exempt from CEQA, qualifies for a
Negative Declaration or whether or not an Environmental Impact
Report (EIR) must be prepared.
The following components constitute the Initial Study for
Development Code Amendment No. 92-03:

recreational services, as defined by Industry Group No. 7999 of the
Standard Industrial Classification Manual, in the CH, Commercial

landslides, mudslides, liquefaction, high wind and other
similar hazards. The amendment could result in the
development of indoor/outdoor recreational facilities in areas
potentially impac~ing biological resources, archaeological
resources, or other adjacent sensitive land uses.
The environmental constraints and concerns of specifi~
developments, their location in relation to hazards and their
potential for impacting resources or other land uses is
project specific. Such issues will be addressed within the
context of specific development applications prior to their
approval pursuant to the provisions of the CEQA guidelines.
4. Conclusions
Potential impacts resulting directly from the proposed
amendment are insignificant since such factors will be subject
to further environmental review at the project specific stage
of development pursuant to CEQA guidelines.
