At the July IS, 1992 meeting of the Commission of the San Bernardino
Regional Airport Authority ("Authority"), the COllllllissioners discussed
the appropriateness of changing the name of the Authority to the San
Bernardino International Airport Authority and the name of the proposed
airport to the San Bernardino International Airport for marketing
purposes. The Commission instructed Authority staff to prepare an
amendment to the existing Airport Authority Joint Exercise of Powers
Agreement. This Amendment revises the Joint Exercise of Powers
Agreement to reflect the changed names of the Authority and the
Commission only, for consideration by the five (5) city members and the
County of San Bernardino.
RECOIMDDATIOR
Staff recommends adoption of the attached Resolution.

6 WHEREAS, the City of San Bernardino (the "City") i. a
7 charter city, duly created and existing pursuant to the
8 Constitution and the laws of the State of california; and

10 WHEREAS, the City is a member of the San Bernardino
11 Regional Airport Authority ("Authority") which is a joint powers
12

authority formed by the legislative bodies of its members
pursuant to a certain agreement entitled "Joint Exercise of
Powers Agreement

15 San Bernardino Regional Airport Authority. ("Agreement.) in
16 accordance with Section 6500, n ~., of the California
Government Code; and

19 WHEREAS, the Authority was created primarily for the
20 purposes of acquiring, operating, repairing, maintaining and
21 administering the aviation related portions of the Norton Air
22 Force Base as a public airport; and
23
24 WHEREAS, the City deems it appropriate to change the
25 name of the Authority to the San Bernardino International Airport
26 Authority, and the name of the Commission of the Authority to the
27 San Bernardino International Airport Authority Commission for
28 marketing purposes; and

1 QEREAS, the City at this ti~ deeu it appropriate to
2 authorize the preparation of a composite "First Amended Joint
3 Exercise of Powers Agreement Creating an Agency to Be Known As
4 The San Bernardino International Airport Authority" (the "First
5 Amended Agreement" ) and to approve Amendment No. 1 to the
6 Agreement, a copy of which is attached hereto as Exhibit "A" and
7 incorporated herein by this reference.

9 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
10 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

12 SECTION 1. The Mayor and Common Council of the City
13 (the "Council") hereby authorizes the preparation of a composite
14 First Amended Agreement and approves Amendment No. 1 to the
15 Agreement, as attached hereto as Exhibit "A" with any such non-
16 substantive changes as may be approved by the Mayor and City
17 Attorney.

19 SECTION 2. The Mayor and City Clerk are hereby
20 authorized to execute Amendment No. 1 to the Agreement and the
21 First Amended Agreement on behalf of the city and take all such
22 other actions as may be necessary in order to implement the
23 provisions of the Amendment No. 1 to the Agreement.

Paragraph 1, Page 1 is revised to read "This First Amended
Agreement, dated for convenience as of , 1992, is
made by and among the County of San Bernardino, City of
Colton, City of Highland, City of Lama Linda, city of
Redlands and city of San Bernardino (hereinafter sometimes
collectively referred to as the "Parties") and includes the
amendments approved by the Parties pursuant to Amendment No.
1 to the original Joint Exercise of Powers Agreement dated
May 12, 1992".
