STAFF REPORT
Bids for the modification of traffic signals at Kendall
Drive and University Parkway were opened at 2:00 p.m., Tuesday,
6-16-92.
A total of 7 bids were received, ranging from $69,996.00
to $81,500.00. The low bid of $69,996.00, is 13.1% below the
Engineer's Estimate of $80,570.00.
Below is an estimate of the total project cost, based upon
the actual low bid price.

An amount of $85,254.70 was paid by the adjacent developer
as mitigation of the impacts created by the development,
reference: Miscellaneous Cash Receipt No. 629398, dated 7-17-90.
The Co-Operative Agreement with the Department of Transportation
provides that Caltrans will pay $27,000, within 25 days after
receipt of a bill as their share of the project cost. These
amounts have been allocated under Account No. 242-362-57473, and
the total ($112,254.70) is sufficient to cover the total esti-
mated project cost.
We recommend that a contract be awarded to the low bidder.

CONTRACT TO PAUL GARDNER CORPORATION FOR MODIFICATION OF TRAFFIC

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION
1.
Paul
Gardner
Corporation
is
the
lowest
responsible
bidder
for:
Modification
of
Traffic
Signals
at
Kendall Drive and University Parkway, per Plans Nos. 7754 and

8299. A contract is awarded accordingly to said bidder for the
total amount of $69,996.00, but such award shall be effective
only upon the contract being fully executed by both parties. All
other bids, therefore, are hereby rejected. The Mayor is hereby
authorized and directed to execute said contract on behalf of the
City; a copy of the contract is on file in the office of the City
Clerk and incorporated herein by reference as fully as though set
forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
