STAFF REPORT
Approximatelv 2 years ago, the City of San Bernardino widened Pepper Avenue
across portions of the East Rialto Storm Drain in conjunction with improving the
railroad crossing at this intersection. There is no Common Use Agreement on file
for this project. Execution of this document will eliminate this problem,
The Flood Control District will not grant an easement over the land in question
as they must also use the area in the maintenance of the East Rialto Storm Drain
at the above location. They have therefore offered a Common Use Agreement which
is acceptable to us, and provides us with the authority to do the necessary work.
This individual acceptance is necessary as the Common Use Agreement from the
County contains certain conditions and covenants. The document, however, does
not contain any unduly adverse restrictions or reservations, and no appropriation
of money is required,
The Flood Control District has accepted our self insurance status as evidenced by
the attached letter, and the subject letter has been attached to the agreement as
required.
Upon execution of the Common Use Agreement by the Mayor, the document will be
returned to the Flood Control District for their execution and recording.
It is therefore Staff's recommendation that the Resolution be adopted and the
document(s) be executed.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
ACCEPTANCE AND EXECUTION OF A COMMON USE AGREEMENT WITH THE SAN BERNARDINO
COUNTY FLOOD CONTROL DISTRICT FOR THE WIDENING OF PEPPER AVENUE AND OTHER
IMPROVEMENTS, ACROSS PORTIONS OF THE EAST RIALTO STORM DRAIN RIGHT-OF-WAY,
AND CONCERNING PROPERTY GENERALLY LOCATED AT THE INTERSECTION OF RIALTO
A VENUE AND PEPPER AVENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1.
That the Mayor of the City of San Bernardino is
hereby authorized and directed to execute and accept on behalf of said City,
9 a Common Use Agreement wi th the San Bernardino Countv Flood Control
10 District, a copy of which is attached hereto and incorporated by reference
11 herein, as fu))v as though set. fort.h in length, marked Exhibit. "A", for the
12 widening of Pepper Avenue, including curbs, gut.ters, landscaping and appurt-
13 enances, more particularly described in said Common Use Agreement. and
14 concerning that certain real property in the City of San Bernardino, County
15 of San Bernardino, State of California, generally located across portions of
16 the East Rialto Storm Drain right-of-way at the intersection of Rialto
17 Avenue and Pepper Avenue. Said City consents to the recordation thereof.

of DIS'lRIcr'S right within AREAS OF CXHm USE. Except in emergencies, CITll
shall give reasonable notice to am obtain written awroval fran the DIS'lRIcr
before perfo:J:Ill:in:J any work on CITll facilities in said AREAS OF CXHm USE,
if which said work will in any way alter or obstJ:uct the flOW' of or potential

any and all claiIns, denJanjs, loss or liability of any kind or nature which the

sustain or incur or which may be iDposed upon them, for property damage and
injury to or death of any persons.

include contractual coverage and autaoobile liability ccwerage for
owned, hired, and non-owned vehicles. 'lhe policy shall have canbinErl

one million dollars ($1,000,000). Errors and anissions liability
insurance with canbinErl s~le limits of $1,000,000 for lxx:li1y injury
and property damage.
CITY shall funrish certified copies of all policies and emorsements to
the DISl'RIcr evidenc~ the insurance coverage above required prior to
tlIe (....,-..cEIIISIlt of perfo1:IIIance of services bereImder, which shall
provide that such insurance shall not be teJ:minated or expire except
without thirty (30) days written notice to the Department.
All policies, with :r:espect to the insurance coverage above required, except
for the Workers' Catpensatian insurance coverage, shall ootain additional
endorsements J'lllltIin;J the DIS'lRIcr and the Camty, their eIlployees, agents,
volunteers and officers as additional named insured with respect to

Dear Mr. Ghaly:
This letter is to inform you that the City of San Bernardino is
Self-Insured for the first $500,000 for any workers' compensation
claim and maintains an Excess Workers' Compensation and Employers'
Liability policy.
The City is Self-Insured for the first $1,000,000 with excess
coverage through the Big Independent cities Excess Pool (BICEP),
per attached certificate.
The following paragraph is inserted as it relates to professional
Liability coverage: .
"Insurance coverage afforded by this policy .shall also
apply to the liability assumed by this Insured under this
Agreement with the county of San Bernardino Flood Control
District for box cuI vert maintenance, provided such
liability results from an error, omission or negligence
of insured, its officers, employees, agents or
subcontractors. All other provisions of this policy are
to remain unchanged.
