Descriotionl Professional Services Finance: Council Notes: 75.0262 AM_". 10__ .,_ t, J .~ I ~ ,,,,,' Request: The request is to prepare a Development Code Amendment to address the deletion of the conditional use permit requirement for the on-site sale of alcoholic beverages at certain restaurants. Background The Development Code requires a CUP for the on-site sale of beer and wine and/or alcohol at restaurants. A restaurant without on- site alcohol sales does not require a CUP. Analysis Generally, there doesn't appear to be a real concern with most sit down restaurants that serve alcoholic beverages in conjunction with the serving of food. We have the ability, through the review process to add the same conditions that we would through the CUP process. By further defining and separating sit down restaurants from bars, nightclubs, etc., we can process applications in a more timely manner and still provide all of the safeguards that would be required. Those safeguards can be included in the Development Code. Funding Requirement staff estimates that it would cost the City approximately $1,200- $1,500 in Planning staff time to prepare this amendment. There is a direct cost for the County filing fee of $25. Recommendation I recommend that the Mayor and Common council direct Planning staff to prepare a Development Code Amendment that would further analyze the deletion of the CUP requirement for sit down restaurants with on-site alcohol sales.
