1 ORDINANCE NO.
2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
18.40.380 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO
3 EXEMPTING RESIDENTIAL PARCEL MAPS AND PREVIOUSLY DEVELOPED
PORTIONS OF ANY NON-RESIDENTIAL ZONED PARCEL FROM THE REQUIREMENT
4 TO UNDERGROUND UTILITIES.
5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1.
Section 18.40.380 of the San Bernardino
7
Municipal Code is hereby amended by addition of Paragraph Nos. 5,
8
and 6, as follows:

"5. Any residential zoned Parcel Map with a maximum of 4
10
parcels, no parcel of which has previously been exempted
11
from this section; and where at least 50% of the
12
surrounding area within a radius of 500 feet has been
13
previously developed without undergrounding utilities.
14
"6. Any non-residential zoned Parcel, the portion
15
previously developed."
