V ernon Ave. from Base Line St. to 16th St. Background: On August 21, 2000, the Mayor and Common Council awarded a contract to Bonadiman- McCain, Inc. in the amount of $550,435.00 for installation of storm drain improvements in Mt. V ernon Avenue from Base Line Street to 16th Street. On December II, 2000, Contract Change Order No. One in the net amount of $4,430.14 for the removal of an existing manhole structure was approved by the City Administrator. During construction, it was found that an abandoned 16" steel water line existed approximately 5 feet deep and immediately above the location of the new storm drain. Given traffic control constraints in the project, other existing utilities in the road, and the potential for settlement due to the abandoned water line, it was deemed necessary to direct the contractor to remove the abandoned water line. Under Section 3-4 "Changed Conditions" of the Standard Specifications, the contractor is allowed to recover additional costs due to "subsurface or latent physical conditions differing materially from those represented in the contract." In addition, the City's Water Department has agreed to reimburse the Capital Improvement Program account for 50% of this cost because the water line removal was considered beneficial to both Departments. The changes are described in the attached change order. TWO FILE NO. 4.7169 DATE: JANUARY 22, 2001 PROJECT: MT VERNON STORM DRAIN IMPROVEMENTS TO: BONADIMAN MCCAIN INC. 280 South Lena Road San Bernardino, Ca. 92408 GENTLEMEN: You are hereby compensated for performing the additional work as follows: Description of Chanl!e Cost Removal of abandoned 16" steel water line on a Time and Materials $ 31,530.53 Basis TOTAL CHANGE ORDER COST $ 31,530.53 JUSTIFICATION: While the contractor was excavating in Mt. Vernon Avenue for the installation of a new storm drain, an abandoned 16" steel water line was encountered. The water line was about 5' deep and interfered with excavation for the storm drain. It was apparent that the water line would have to be removed to allow installation of the storm drain. Staff checked with the City Water Department and determined that the water line was probably abandoned in the 1950's when it was replaced by a larger water line. It was also determined that the abandoned water line more than likely extended the full length of the storm drain project from Base Line Street to 16th Street. It was apparent that the abandoned water line would have to be removed the full length of the project. In addition, administrative changes have been implemented in the utility agency review process with respect to abandoned water lines to minimize the possibility of similar future conflicts. Vernon Storm Drain Improvements Page 2 of2 Under the provisions of Section 3-4 "Changed Conditions" of the Standard Specifications, the contractor is entitled to a change order to adjust compensation when subsurface conditions not shown on plans are encountered, The additional work necessary to remove the abandoned 16" steel water line is categorized as "Extra Work" under the provisions of Section 3-3 of the Standard Specifications. Based on that provision, staff authorized the contractor to proceed with removal of the abandoned water line on a Time and Materials (T & M) basis. T & M "Extra Work" reports covering the period November 19,2000 through January 3, 2001, prepared by the contractor and verified by the City Construction Inspector, are attached and made a part of this change order. Grubbs, Field Bryden, Director, Water utilities of Development Engineer; Bill I have reviewed the information set forth in your memo dated December 14, 2000 concerning the abandoned 16" water line that was discovered when your contractor was excavating for the Mt. Vernon Storm Drain project. When the department responded to the utility notice letter sent during the design phase of the project, we identified all known facilities that we had in the area. It was not known during that time that there was an abandoned 16" line in Mt. Vernon. When we were notified of the situation, staff went back through thirty years of records to see if we could determine when the line was abandoned in place, and found no information. We are changing our procedures so that our base maps will reflect abandoned lines when they occur to avoid this situation. Without having someone in the Engineering Section that was here more than thirty years ago, there is no way we would have been able to provide information to Public Works about the abandoned line. Abandonment of facilities in place is the typical procedure for water and sewer lines. I have received a copy of the change order for the additional work of removing the abandoned 16" line for $31,530.53 that will be submitted to the Mayor and Common Council for approval.
