STAFF REPORT
The vacation of a portion of the northwest corner of 40th
Street and Kendall Drive (Attachments A and B) is proposed in
relation to the development and realignment of the curb along
the area of proposed vacation.
The proposed development and curb realignment will result in
a surplus parkway right-of-way for the City. Vacating the
surplus area would bring the parkway into conformance with
City standards. In addition, this street vacation is not in
conflict with the land use and circulation elements of the
General Plan.
The project was reviewed by the Environmental Review Commit-
tee on July 23, 1987, and a determination made that the
proposed project could not have a significant effect on the
environment. The ERC recommends adoption of a Negative
Declaration. The required ten (10) day public review period
began on August 5, and expired on August 14, 1987. No
comments were received.
Required Health and Safety Findings were approved by Council
on September 8, 1987.
