STAFF REPORT
This ordinance amends Chapter 9.80 of the San Bernardino Municipal
Code to make it a misdemeanor to carry a concealed weapon in the
City. Such violations must currently be prosecuted as infractions,
with a maximum $IOO.OO fine for a first violation. The conduct to
be controlled is the carrying of knives. ice picks, etc. This
section does not conflict with California Penal Code Section 12000,
et seq. which relates to the carrying of concealed firearms.

Justification Clause: Due to the large number of items submitted to
the City Attorney for review, there was not
sufficient time to get this on the regular
Agenda.
The police have requested that this be enacted
as soon as is possible.

ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
9.80.060 OF THE SAN BERNARDINO MUNICIPAL CODE TO MAKE A VIOLATION
OF CHAPTER 9.80 A MISDEAMEANOR AND AMENDING SECTION 1.12.010 TO
INCREASE THE PENALTY FOR A MISDEAMEANOR COMMITTED WITHIN THE
CITY'S JURISDICTION.
THE ~mYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Section 9.80.060 of the San Bernardino Municipal
Code is amended to read as follows:
"9.80.060 Violation-Penalty.
Any person violating any provi~ion of this chapter is guilty
of a misdeameanor which upon conviction thereof is punishable in
accordance with the provision of section 1.12.010 of the code."
SECTION 2. Section 1.12.010 of the San Bernardino Municipal
Code is amended to read as follows:
"1.12.010 Designated.
A. The punishment for any offense declared to be a misdea-
meanor or declared to be unlawful with no designation as to the
nature of the offense by the Charter or an ordinance, except in
cases where a different offense or a different punishment is pre-
scribed by ordinance or any applicable law of this state, is
imprisonment in the county jail not exceeding six months, or a
fine not exceeding one thousand dollars, or both such imprison-
ment and fine."
