8ids for this project were opened at 2:00 p.m. on
Tuesday, 8-18-87.
A total of 4 bids were received, ranging from $36,876.00
to $48,261.00. The low bid of $36,876.00 is 9.7% under the Engi-
neer's Estimate of $40,850.00.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO DBX INCORPORATED FOR INSTALLATION OF STREET LIGHTS ON
WATERMAN AVENUE, FROM CENTRAL AVENUE TO MILL STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. DBX, INCORPORATED is the lowest responsible
bidder for: Installation of Street Lights on Waterman Avenue,
from Central Avenue to Mill Street, in accordance with Plan No.
7265, for the total amount of $36,876.00, a contract is awarded
to said bidder accordingly, but such award shall be effective
only upon the contract being fully executed by the parties; all
other bids therefor are hereby rejected; and the Mayor is hereby
authorized and directed to execute said contract on behalf of the
City; a copy of the contract is attached hereto, marked Exhibit
nAn and incorporated herein by reference as fully as though set
forth at length.
SECTION 2. Execution and Amendments. This contract and
18 any amendments or modifications thereto shall not take effect or
19 become operative until fully signed and executed by the parties
20 and no party shall be obligated hereunder until the time of such
21 'full execution. No oral agreements, amendments, modifications or
22 waivers are intended or authorized and shall not be implied from
23 any act or course of conduct of any party.
24 SECTION 3. Allor a portion of the funds to be utilized in
25 the construction of the project are provided by the United States
26 Department of Housing and Urban Development. (HUD) This
27 contract and any amendments or modifications thereto shall not

1 take effect or become operative until fully signed and executed
2 by the parties in the manner required by the applicable HOD
3 regulations and no party shall be obligated hereunder until the
4 time of such full execution. No oral agreements, amendments,
5 modifications or waivers are intended or authorized and shall not
6 be implied from any act or course of conduct of any party.
7 I HERESY CERTIFY that the foregoing resolution was duly
8 adopted by the Mayor and Common Council of the City of San
9 Bernardino at a meeting thereof, held on
