Synopsis of Previous Council action:
At Council meeting of 8-17-87, Cou~cil directed City Attorney's
office to prepare an ordinance preventing the sale of animals
for experime~tation purposes. Ordinance was to be on Agenda
for review at September 8, 1987 Council Meeting.

STAFF REPORT
At the meeting of the Mayor and Common Council on Monday,
August 17, 1987, a proposed initiative ordinance to prevent the
sale of animals by the City for experimentation purposes was
discussed. In an attempt to save the cost of verifying the
numerous signatures and to save the cost of such an election,
the Mayor and Council directed this office to bring back such
an ordinance for possible Council action.
The language proposed is the same as that outlined in the
initiative provision.

unwanted or unclaimed snimals" to approved Research Institutions on Tuesday,
September 8, 1987 at about 9:30 AM.
In anticipation that the council will invite testimony from concerned citizens

"The sale of impounded animals from public shelters to biomedical
research laboratories, training institutions and other facilities that
use animals for experimental, testing or teaching purposes contributes
to a breakdown of effective animal control programs through abandonment
of pets by owners who feel such animals may be subjected to painful
use", said Deborah'L. Biggs, Acting Director of Animal Control for the
City of San Bernardino,
On July l6,1987 the City of San Bernardino Animal Control adopted
a policy relating to animals available for sale to research institutions.
This policy covered areas such as the days and hours that research
personnel could make their selections as well as the classifications of
animals that would not be available. One point of the policy satates
that "no owner release animals (will be sold to research) unless
specifically requested in writing by the former owner.~ From January 1,
1987 to July 31,1987 only .37% of the owners who voluntarily turned their
animals over to the custody of the Animal Shelter indicated that they
did want their animals to be used for research, according to Ms. Biggs.
"With the enormous amount of publicity surrounding the new policy,
our public trust has increased", Ms. Biggs said. Statistics gathered
from one year prior to the new policy and one year later clearly show
a marked increase in the use of the shelter's services. According to
Ms. Biggs, more owners turned in their animals rather than abandoning
them on the city's streets- 28.69% prior to the policy change compared
to the current 33.16%. More animals were returned to their owners and

inception of the new policy, The national average for animals returned
to society- (RTS rate), according to a spokesperson for the Humane Society
of the United States, is 15%. The Shelter currently boasts a 21.26%
RTS rate, compared to 16.8% prior to the policy change.
"We feel that because of our policy change, we have gained the
trust confidence and support of the citizens as a viable and dependable
public service agency", said Ms. Biggs.

Section 6.24.l60 of the San Bernardino

9 The City of San Bernardino shall not sell, give away, or
10 donate, directly or indirectly, any animal for the purpose of
11 research, education, testing, demonstration or experimentation,
12 to any person, organization or institution."
