Synopsis of Previous Council action:
None.
Recommended motion:
1) That a finding be made that the vacation of a portion of the northwest corner
of 40th Street and Kendall Drive, in accordance with Plan No. 7254, is needed
for health and safety reasons.
2) That Plan No, 7254 for the vacation of a portion of the Northwest corner of
40th Street and Kendall Drive be approved and that the City Engineer and the
City Clerk be authorized to proceed.

STAFF REPORT
A request was received to vacate a portion of the Northwest
corner of 40th Street and Kendall Drive from the owner who
adjoins the portion to be vacated relative to a development.
This request represents 100% of those owners who adjoin the
street. The petitioner has deposited the required $200.00,
which represents one-half of the total fee of $400.00. The
remaining $200.00 will be due after the investigative
proceedings.

Due to the development and realignment of the curb along the
area proposed for vacation, the City will have surplus right of
way. Parkways within the area range from 4 to 7 feet, which is
within City standards; however, the area proposed for vacation
exceeds the City standards by as much as l4 feet. Vacating the
surplus area would not only conform to City standards, but
would improve traffic conditions and, reduce danger to the
public.
