Recommended motion:
1, Adopt resolution.
2. That the transfer of $99,000, from the available fund balance
for the Storm Drain Construction Fund to Account No. 248-368-57818,
"Master Plan Storm Drain 6-21, North of Patton Hospital, be approved.

STAFF REPORT
Bids for this project were opened at 2:00 p.m. on 4-21-87.
A total of 8 bids were received, ranging from $239,952 to $429,475. The
low bid of $239.952.60 is 15.2% over the Engineer's Estimate of $208,250.00.
Property owners have been notified of the construction to be done with-
in the City's existing drainage easement and have made provisions to remove
or relocate items they wish to salvage.
Listed below is the total estimated project cost, based upon the actual
low bid price:

An amount of $200.000.00 has been allocated under Account No. 248-368-
57818, in the Storm Drain Construction Fund. It is recommended that the
necessary supplemental funds be transferred from the available fund balance
in the Storm Drain Construction Fund.
We feel the low bid price represents the lowest cost that we can
reasonably expect to receive. Therefore, we recommend that a contract be
awarded to the low bidder.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO J & B CONTRACTORS. INC. FOR CONSTRUCTION OF A STORM
3 DRAIN BETWEEN CITRUS AVENUE AND MIRADA ROAD, 620 FEET EAST OF
VICTORIA AVENUE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. J & B Contractors, Inc. is the lowest
7 responsible bidder for construction of a storm drain between
8 Citrus Avenue and Mirada Road, 620 feet east of Victoria Avenue.
9 in accordance with Plan No. 7106. for the total amount of
10 $239,952.60. and a contract is awarded to said bidder accordingly,
11 but such award shall be effective only upon the contract b~ing
12 fully executed by the parties; all other bids therefor are
13 hereby rejected; and the Mayor is hereby authorized and directed
14 to execute said contract on behalf of the City; a copy of the
15 contract is attached hereto, marked Exhibit "A" and incorporated
16 herein by reference as fully as though set forth at length.

SECTION 2.
This contract and any amendments or
18 modifications thereto shall not take effect or become operative
19 until fully signed and executed by the parties and no party
20 shall be obligated hereunder until the time of such full execution.
21 No oral agreements. amendments, modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.
24 I HEREBY CERTIFY that the foregoing resolution was duly
25 adopted by the Mayor and Common Council of the City of San
26 Bernardino at a meeting thereof, held on
27 the day of , 1987, by the following
