CI'O ()II SAN ..RNAfIDO) - RIIQUIOr FOR COUtICIL AC'QoN STAFF REPORT Tentative Tract No. 13296 was approved by the Planning Commission on May 6, 1986. Tentative Tract No. 13296 is an 18-lot Single Family Residential subdivision. The subdivider elected to construct all required improvements rather than post the required bonds for the work. The improve- ments will be completed prior to the recordation of .the final map. The subdivider has posted a cash security for the guarantee/ warranty bond, has submitted the standard subdivision agreement and is requesting the recordation of the final map. Improvements along Pennsylvania Street are anticipated to be com~ pleted by the Public Services Department, including the area adjacent to the development. Bonding for the completion of this work and for the guaranteelwarranty of this work has not been re- quired. The final map has been reviewed and found to be substantially in compliance with the tentative map and the Subdivision Map Act. Therefore, we recommend that the Final Map be approved and recorded. subject to all improvements being completed in a satisfactory manner and the execution of the standard subdivision agreement. URGENCY CLAUSE The Ward Councilman has requested this item be considered on the supplemental agenda due to the extreme hardship on the developer. Construction has been underway nearly one full year and without the recorded map, certificates of occupancy may not be issued, allowing the sale of the homes. Tract No. 13296 o - ~ ~.I. - Il;l ~ !I o o o 1 RESOLUTION NO. 2 RESOtUTION OF THE CITY OF SAN BERNARDINO APPROVING THE FINAL MAP FOR SUBDIVISION TRACT NO. 13296, LOCATED ON THE EAST 3 SIDE OF PENNSYLVANIA AVENUE, APPROXIMATELY 506 FEET NORTH OF BASELINE STREET, ACCEPTING THE PUBLIC DEDICATIONS AS SET FORTH 4 ON SAID MAP; AND AUTHORIZING EXECUTION OF THE STANDARD FORM OF AGREEMENT FOR THE IMPROVEMENTS IN SAID SUBDIVISION,WITH TIME 5 FOR PERFORMANCE SPECIFIED. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 1: The Mayor and Common Council find that proposed Subdivision Tract No. 13296, located on the east side of Pennsylvania Avenue, approximately 506 feet north of Base1in~ Street, together with the provisions for its design and improvemenG is consistent with the General P1 an of the City of San Berna'rclino. SECTION 2: The Mayor of the City of San Bernardino. . is authorized on behalf of said City to execute the standard form of agreement adopted by Resolution No. 84-8 with Triple H. Mortgage Service, Inc., for the improvements in said subdivision tract as are required by Title 18 of the San Bernardino Municipal Code and the California Subdivision Map Act. The time for performance is specified at 24 months. Said improvements are specifically described and shown on Drawings Nos. 6249 & 6250, approved and on file in the Office of the City Engineer of the City of San Bernardino. SECTION 3: The Final Map of said subdivision tract is ereby approved and the City of San Bernardino hereby accepts s public property all dedications within the subdivision as hown on said Final Map for streets, alleys, (including access ights), drainage and other public easements. As a condition recedent to approval of the Final Map, the Subdivider shall /14/87 o o o o 1 first execute the agreement referenced in Section 2 hereof for 2 the improvements within said subdivision.
