STAFF REPORT
Staff and tbe Redevelopment Committee are recommending entering into an agreement
witb tbe City (Public Services Department) for ongoing weed abatement services.
BACKGROUND
In tbe past, Public Services would issue notices to tbe Agency tbrougbout tbe year
entitled "A Notice to Clean Premises". In tbe notice, it is determined that tbe
property supports tbe growtb of weeds, dead or dry palm and grass wbicb are
seasonal and recurrent nuisances, that must be removed or abated from time to time
on all Agency-owned properties on an "as-ueeded" basis. Upon verification that
tbe property is owned by tbe Agency, a Purchase Order is issued. After tbe
properties bave been disked and cleared of all debris and combustible materials,
an inspection is made of said property, and a bill is submitted from tbe Finance
Department for payment.
To speed tbis process along, Staff bas proposed that we enter into a yearly
agreement witb Public Srvices to perform tbis service on an as-ueeded basis. Mr.
Moreno bas concurred.
Tbe Agreement before you provides that tbe City will provide tbe service, inapect
tbe site to verify tbat tbe work has been done and invoice tbe Agency. The
contract is for a yearly not-to-exceed contract in tbe amount of *5,000.
Staff will provide Public Services witb a list of currently-owned properties.

RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE
CITY OF SAN BERNARDINO AUTHORIZING AND DIRECTING THE EXECUTION OF
AN AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND THE
REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO FOR WEED
ABATEMENT SERVICES RELATING TO AGENCY-OWNED PROPERTIES.
BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Chairman and Secretary of the Community
Development Commission of the City of San Bernardino are hereby
authorized and directed to execute for and on behalf of the
Redevelopment Agency of the City of San Bernardino an agreement
between the Redevelopment Agency of the City of San Bernardino
and the City of San Bernardino for weed abatement services
relating to Agency-owned properties, with such non-substantive
changes to said agreement as may be approved by the Chairman and
Agency Counsel. A copy of said agreement is attached hereto as
Exhibit "1" and incorporated herein by this reference as though
fully set forth at length.

REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO FOR WEED
ABATEMENT SERVICES RELATING TO AGENCY-OWNED PROPERTIES
THIS AGREEMENT, made and entered into effective the
day of
, 1987, by and between the CITY OF
SAN BERNARDINO, a municipal corporation, hereinafter "City", and
the REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO, a public

body corporate, hereinafter "Agency", constitutes the agreement
of the parties relative to weed abatement services for Agency-

owned properties.
The parties agree as follows:
1. On any property owned by Agency which have become
overgrown with weeds so as to require abatement under the
provisions of the San Bernardino Municipal Code, the Department
of public services shall be authorized to provide the necessary
weed abatement services as required, without advance notification
to the Agency.
Prior to actual performance of weed abatement services, City
shall cause to be inspected any Agency-owned property within the
city limits which it believes to be in need of weed abatement.
Upon ascertaining that such lot in fact does require weed
abatement, the City shall proceed to render weed abatement
services, and shall, promptly after such services, inspect the
site to make certain that the services have been performed in a
reasonable manner. Thereafter, City shall submit a bill to
Agency for the services provided.
2. Agency agrees to pay to City, upon billing from City,
reasonable weed abatement charges for all Agency-owned property

1 on which weeds have been abated pursuant to the provisions of the
2 San Bernardino Municipal Code. Agency specifically waives
3 advance notice of such intended action, and the right to a
4 hearing on such proposed action. Agency consents to the removal
5 of such weeds by City. After City has inspected the completed
6 work, and submitted its bill to Agency, Agency shall reimburse
7 City for the actual costs of such weed abatement services. Total
8 costs under this agreement shall not exceed $5,000, without
9 express written approval of the Executive Director of the Agency.
10 Executive Director is authorized to agree to an amount greater
11 than $5,000 per year.
12 3. City shall exercise reasonable diligence in notifying
13 Agency prior to exceeding the $5,000 cap agreed to hereunder.
4:) 14 Agency shall not be liable for amounts over the $5,000 limit
15 unless otherwise agreed in writing as specified above. This
