STAFF REPORT
On February 17, 1987, a Resolution confirming the Assessment Roll
for improvements made on 20 parcels of land in the City under
Chapter 27 of the 1911 Improvement Act was adopted.
Certain protests as to the ~igh costs were documented after' the
fact, and your Honorable Body sent the matter to the Ways and
Means Committee for recommendation. At their meeting of March
16, 1987, the Committee recommended that the City absorb the
cost of incidentals relative to the project. At your meeting of
March 23, 1987, a motion was made to absorb the incidental costs
and directed the Director of Public Works to preoare a new
assessment roll.
In the process of obtaining a breakdown of incidental costs from
Finance for the Ways and Means Committee meeting, it was observ-
ed that the outside contract costs were lower than what was
originally submitted by Finance for assessment. The problem
was found, justified, and the new assessment roll has been pre-
oared and is attached to the Resolution to reflect all of the
reductions in cost.
Attached is the new Report and the Resolution confirming the
Report and Assessment for your action. Notice of the reduction
in cost was mailed to each of the property owners on 3/30/87.

A RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING
THE REPORT ~F THE DIRECTOR OF PUBLIC WORKS/CITY ENGINEER FOR
THE CONSTRUCTION OF CERTAIN IMPROVEMENTS TO VARIOUS PROPERTIES
IN THE CITY OF SAN BERNARDINO, PLACING A LIEN THEREON,
CONFIRMING THE 1987-BB ASSESSMENT ROLL AND RESCINDING
RESOLUTION NO. 87-49.
WHEREAS, pursuant to the provisions of Chapter 27 of
the Improvement Act of 1911, the Mayor and Common Council of
the City of San Bernardino did on the 17th day of December,
1984, order the construction of certain improvements by
property owners of various properties within the City of San
Bernardino, which construction was to be commenced by February
3, 19B5; and
WHEREAS, the said construction was not commenced by
said date and the Director of Public Works/City Engineer caused
said work to be done; and
WHEREAS, according to the provisions of said Chapter
27, a report has been filed by said Director of Public
Works/City Engineer specifying the work which was done, the
cost of construction, a description of the real property in
front of which the work was done and the assessment against
each lot or parcel of land proposed to be assessed to pay the
.cost thereof; and
WHEREAS, the Mayor and Common Council, at their meeting
of February 17, 1987, adopted Resolution No. 87-49 confirming
the assessment roll; and
WHEREAS, the Mayor and Common Council, at their meeting

1 Works to prepare a new assessment roll which reflects their
2 action;
3 Nnw THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY
4 OF SAN BERNARDINO DO RESOLVE AS FOLLOWS:
5 SECTION 1. That Resolution No. B7-49 adopted February
6 17, 19B7, is hereby rescinded.
7 SECTION 2. That the Mayor and Common Council do hereby
8 find and determine that the costs to be levied against the
9 parcels of land as delineated in the report by the Director of
10 Public Works/City Engineer, attached hereto as Exhibit "A and
11 incorporated herein by reference, are correctly set forj;h and
12 do hereby confirm said report and costs.
13 SECTION 3. That the City of San Bernardino, acting
14 through its Director of Public Works/City Engineer, does hereby
15 claim a lien on all of the properties listed in said report in
16 the amounts so 1 isted which are not paid wi thin five (5) days
17 from the date of this Resolution and the same shall be a lien
18 upon said real property and collected with the annual property
19 taxes over a period of three years until the said sums, with
20 interest at the rate of 7% per annum on the unpaid balance, are
21 paid in full.
22 SECTION 4. That the assessment roll, designated as
23 Exhibit "B" and attached hereto, representing the correct pro-
24 portionate costs to be levied against the parcels of land as
25 set forth thereon for 19B7-B8, is hereby confirmed.
26 SECTION 5. That pursuant to Section 5B93 of the
27 Streets and Highways Code of the State of California, the City

Clerk is directed to cause a copy of this Resolution and a list
of the unpaid assessmentl for 19B7-B8 including interest, to be
transmit~ed to the Office of the Auditor-Controller for the
County of San Bernardino with the request that the individual
assessments be placed on the subject property tax bills for
collection together with all other property taxes.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a meeting thereof held on
