Synopsis of Previous Council action:
A similar ordinance amending Section 9.90.010 of the Municipal
Code was reviewed on second reading on March 23, 1987 by the
Council. That ordinance allowed Env ironmenta 1 Control Per sonne 1
and Water Reclamation personnel to issue Notices to Appear.
3/26/87 Legislative Review Committee recommended adoption.
Recommended motion:
waive further first reading of ordinance and layover for final
adoption.

STAFF REPORT
To continue using civilian personnel as much as possible to assist
in the delivery of police service, the attached ordinance is recommended.
This ordinance allows civilian police assistants to enforce State and
Municipal Codes. They will not make physical contact with or take
physical custody of violators. This ordinance simply allows them to
take the enforcement action necessary to complete a report and/or a
citation releasing the violator on the violator's promise to appear.
If circumstances appear to require physical contact or custody, then
the police assistant will call for a sworn police officer.
I believe that we can continue to provide the same quality police service
while providing more time available to the sworn police officer to
prevent crime, apprehend the violator, and spend time with members
of the community developing their support and action toward crime
reduct. n/

VIOLATIONS OF STATE STATUTES PURSUANT TO CALIFORNIA PENAL CODE

6 THE MAYOR AND CO~ON COUNCIL OF THE CITY OF SAN
BERNARDINO DO ORDAIN AS FOLLOWS:

8 SECTION l. Section 9.90.010 Subsection A Paragragh 2 of
9 the San Bernardino Municipal Code is amended to read:
10 "2. Police Assistants are authorized and empowered to
11 arrest and issue notices to appear for violations of the
12 provisions of this Code and state statutes pursuant to
13 California Penal Code section 836.5."
