STAFF REPORT
On March 6, 1987, this office received a request from Vanir
De vel 0 p men t Com pan y, In c. 0 n be h a 1 f 0 f L. Y . W. I n ve s t men t
Company, the new owners of the property at 1721 N. Conejo
Drive, to initiate proceedings to vacate 17th Street, East of
Conejo Drive.
On March 23, 1987, your Honorable Body authorized the City
Clerk and the City Engineer to proceed with the requested
vacation.
Access easements will be reserved in the resolution ordering
vacation for the abutting property to the South and East, Flood
Control District, and City emergency and serving utility
vehicles.
The proponents have been notified by letter on April 2, 1987,
and have responded with notification for us to proceed. The
required $400.00 fee has been paid.
The Resolution of Intention, which sets a protest date of May
18, 1987, has been attached for your action.

A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING
ITS INTENTION TO ORDER THE VACATION OF A PORTION OF 17TH
STREET, EAST OF CONEJO DRIVE, AND RESERVING PUBLIC UTILITY
EASEMENTS, AND AN EASEMENT FOR INGRESS AND EGRESS TO THE COUNTY
OF SAN BERNARDINO TO SERVE THE FLOOD CONTROL CHANNEL AND BRIDGE
TO THE EAST, AND FOR THE CITY OF SAN BERNARDINO EMERGENCY
VEHICLES AND SERVING UTILITY COMPANY VEHICLES, AND ABUTTING
PROPERTY OWNERS THEREOF.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the
City of San Bernardino hereby declares its intention to order
the vacation of a portion of 17th Street, East of Conejo Drive,
in said City, which said portion is more particularly described
as follows:
The South 15.00 feet of Lot 10, Tract 2316 as
per plat thereof recorded in Book 33 of Maps,
page 31, records of the County Recorder of San
Bernardino County.
SECTION 2. That the Mayor and Common Council of the
City of San Bernardino, in vacating the above described portion
of said street, elects to proceed under and in accordance with
the provisions of the "Public Streets, Highways and Services
Vacation Law", being Division 9, Part 3, of the Streets and
Highways Code of the State of California.
SECTION 3. That the hour of 10:00 A.M. on the 18th day

Bernardino, California, be, and the same hereby is fixed as the
time and place when and where all persons interested in or
Objecting to the proposed vacation may appear before the said
28 Mayor and Common Council and offer evidence in relation

1 thereto. For further particulars as to the proposed vacation
2 of the hereinbefore described portion of said street, reference
3 is made to that certain map marked "Plan No. 7024" approved
4 July 7, 19B6, on file in the office of the City Clerk of said
5 City.
6 SECTION 4. Nothing in this Resolution shall in any
7 way affect or disturb any existing easement for public utility
8 purposes belonging either to the City of San Bernardino or to
9 any public utility, and there is hereby reserved for future
10 general public utility purposes and for this City an easement
11 reasonably necessary to locate such public utility facilities
12 in, over, under and across the real property hereinabove
13 described, and to use, maintain, repair, replace or renew such
14 facilities, and an easement for ingress and egress to the
15 County of San Bernardino to serve the flood control channel and
16 bridge to the East, and for the City of San Bernardino

18 property owners thereof.
19 SECTION 5. That the City Engineer of the City of San
20 Bernardino hereby is directed to cause Notices of Street
21 Vacation to be posted as required by the "Public Streets,
22 Highways and Services Vacation Law".
23 SECTION 6. That the City Clerk shall certify to the
24 adoption of this Resolution of Intention and shall cause the
25 same to be publ i shed once a week for two successi ve weeks in
26 The Sun, a newspaper published and circulated in the City of
27 San Bernardino, prior to the date of the above public hearing.
