This action is part of the city Council's ongoing efforts for improved air safety measures in light of the air disaster which occurred here last August. Washington, D.C. 20423 Dear Ms McGee: As duly authorized counsel for the Department of Defense (000), the undersigned hereby submits this response on behalf of 000 to the applicants' Supplement to Petition to Reopen and requests that the response be considered by the Commission. Although DOD is not a party to the proceeding, it is noted that the applicants' Petition and Supplement states that various shippers made statements in support of the request that the proceeding be reopened. As an interested shipper, 000 desires that its concerns be considered similarly. DOD is an'interested shipper because more than 8,000 miles of the carriers' rail lines are designated for tne 33,000-mile Strategic Rail Corridor Network (STRACNET). STRACNET is the integrated and interconnected mainline network important to national defense. These two carriers serve 65 major defense installations. A subset of these installations is served by the applicants' rail lines designated important to national defense (45). See list (Encl 1). DOD concerns include: (1) the economic ability of the applicants, individually or merged, to continue uninterrupted service over their rail lines, particularly those that are designated important to national defense; (2) Santa Fe Southern Pacific Corporation's announcement on November 20, 1986, that the Atchison, Topeka and Santa Fe Railway Company and the Southern Pacific Transportation Company each plan to divest 3,1~0 miles of track, and (3) the availability of - - - . - ~ ~ ~ - - . Q 0 0 o -2- competing railroads to serve defense installations requiring rail service. In regards to abandonments, the Military Traffic Management Command inquired as to the impact upon designated defense lines. Chairman Schmidt, Santa pe Southern Pacific Corporation (SFSPC), referred the matter to Chairmen of the AtChison, Topeka and San~a Fe Railway Company and the Southern pacific Transportation Company (Encl 2). Chairmen Swartz and McNear of those respective rail units indicate no plans or intent to involve designated defense lines in sales or abandonments (Encls 3 and 4). (The only exception is Southern Pacific's Mina Branch which serves Hawthorne Army Ammunition Plant, Hawthorne, Nevada, and which is a subject of current negotiations among more than a dozen interested parties.) The individual rail units address their respective networks, pre- merger sales and abandonments, and apparently lack purview to address;postmerger sales and abandonments. The parent corporation (SFSPC) expresses concern about the importance of railroads to national defense but makes no commitment regarding postmerger sales and abandonments. 000 is apprehensive about postmerger sales and abandonments of designated defense lines. In regards to the availability of competing service, there appears to be offsetting net impacts upon defense installations requiring rail service to accomplish their assigned mission. Merger of the AtChison, Topeka and Santa Fe Railway Company and the Southern Pacific Transportation Company would result in .direct slngle carrier service to two such installations (Concord Naval Weapons Station, Concord, CA and Marine Corps Air Ground Combat Center, 29 Palms, CA). Lease and trackage agreements provided by the applicants to the Denver Rio Grande and Western: Union pacific-MOPAC, Missouri Kansas Texas, and Texas Mexican Railroads (and vice versa) would increase access to seven installations as a result of single carrier service mecoming multiple carrier service. These installations include: Hawthorne Army Ammunition plant, Hawthorne, NV, Yuma proving Ground, Yuma, AZ, Marine Corps Air Station, Yuma, AZ, Davis-Monthan Air Force Base, Tucson, AZ, Naval Plant Representative Office, Vought Corp., Dallas, TX, Sacramento Ammunition Depot, Sacramento, CA, and Travis Air Force Base, Fairfield, CA. This means that access to rail competition and alternate sources of rail cars in the event of defense mobilization and contingency would be lost for two (2) defense installations and gained at seven (7) defense installations. - - - - 4. ..JL. 411 - - . . BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. A. The Mayor and Common Council additionally support the California Legislature in urging all counties in" the State of California which host major commercial air traffic to support the emergency request study of bistatic radar and to provide funding for same. C. The City Clerk is hereby directed to forward a copy of this resolution to U.S. Senators Alan Cranston and Pete Wilson, to U.S. Representatives George Brown and Jerry Lewis, to State Senators H. L. Richardson and Ruben Ayala, and to State Assemblymen William Leonard and Jerry Eaves.
