2 URGENCY ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SAN
BERNARDINO MUNICIPAL CODE SECTION 10.14. 190(A) TO PROHIBIT ALL
3 COMMERCIAL VEHICLES EXCEPT FOR COMMERCIAL PICKUP TRUCKS, VANS,
AND PASSENGER CARS ON MT. VERNON AVENUE BETWEEN STH STREET AND 2ND
4 STREET (MT. VERNON AVENUE BRIDGE).
5 WHEREAS, the existing Mt. V ernon Avenue Bridge was constructed by the State in 1934,
with some of the steel framing salvaged from the previous bridge, which was built by the railroad in
6 the early 1900's; and
7 WHEREAS, in 2004, Inspectors from the Caltrans Office of Structure Maintenance &
Investigations discovered cracks in the steel girders at several locations under both the north and
8 southbound lanes of traffic. Based upon the recommendation of Caltrans, the City closed the bridge
temporarily until it could be shored. In June of2004, shoring with heavy timbers was completed and
9 the bridge was re-opened with the restriction that 18 wheel trucks were prohibited from using the
bridge; and

WHEREAS, in April of 2008, Caltrans advised City staff that additional cracks had been
11 discovered in several girders that were not shored;
12 WHEREAS, on August 26,2008, the City received another inspection report from Caltrans
which identified newly discovered buckling in the center 3 girders of span 6. The City is in the
13 process of designing and will install additional shoring in the area of the new cracks and buckling; and
14 WHEREAS, on August 28,2008, Robert Eisenbeisz, City Engineer, issued a memorandum
stating that based on information contained in the most recent Caltrans inspection report, Mr.
15 Eisenbeisz recommended that all commercial vehicles except for commercial pickup trucks, vans and
passenger cars be prohibited on the Mt. Vernon Avenue Bridge;

NOW THEREFORE, the Mayor and Common Council of the City of San Bernardino do
17 Ordain as Follows:
18 Section 1. San Bernardino Municipal Code Section 10.24.190(A) is hereby amended to
add Subsection (23) to read as follows:

Commercial Vehicles Prohibited on Certain Streets.
"A. Pursuant to the authority and restrictions of Vehicle Code Sections 35701, et
21 seq., no person shall operate or drive any commercial vehicle upon the
following streets, and the Traffic Engineer shall cause appropriate signs to be
22 erected giving notice thereof.

(23) Mt. Vernon Avenue between 5th Street and 2nd Street (Mt.
V ernon Avenue Bridge), except for commercial pickup trucks,
vans, and passenger cars."
25 Section 2. This urgency ordinance shall take effect upon adoption and is adopted pursuant
to San Bernardino City Charter Section 31 and 121, by a two-thirds (2/3) vote of the Council, for the
26 immediate preservation of the public peace, health, or safety. The Mayor and Common Council find
that all of the above-stated recitals are true and hereby incorporate them herein as the statement of
27 urgency supporting this ordinance.

Section 3.
Compliance with the California Environmental Quality Act.
6 The Mayor and Common Council fmds that the adoption of this Urgency Ordinance is not
7 subject to the California Environmental Quality Act (CEQA) pursuant to the categorical exemption
8 under Title 14 California Code of Regulations Section 15321, actions by regulatory agencies to
9 enforce any law, rule, standard or objective administered or adopted by the agency.
