Sierra Way and the lease agreement with the landlord, Mr. Robert Whiteside, was approved by the Mayor and Council, Resolution #86-117. This lease agreement expires March 31, 1987, and renewal of the lease is re- quested in order to maintain the San Bernardino Pol ice Department I s current operation. RESOWTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A LEASE WITH ROBERT WHITESIDE FOR PREMISES LOCATED AT 4222 NORTH SIERRA WAY FOR USE AS A POLICE COMMUNITY SERVICE OFFICE OR OTHER LAWFUL PURPOSE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San B.rnardino is hereby authorized and directed to execute on behalf of said City a Lease with Robert Whiteside for premises located at 4222 North Sierra Way for use as a police community service office or other lawful purpose, a copy of which is attached hereto, marked Exhibit "An and incorporated herein by reference as fully as though set forth at length. Recitals. 9 A. Landlord is the owner of the premises described 10 as 4222 North Sierra Way in the City of San Bernardino and 11 desires to lease said premises to City for use as a community 12 service office by the Police Department of the City of San 13 Bernardino, and for other lawful purposes as determined by the 14 City. 15 B. City desires to lease the premises from Landlord 16 pursuant to the provisions stated herein. 17 2. DescriDtion of Premises. Landlord leases to City, 18 and city lets from Landlord, as herein provided, the premises 19 located at 4222 North Sierra Way, City of San Bernardino, 20 County of San Bernardino, State of California, and appurtenant 21 rights. City shall have full and unimpaired access to the 22 premises at all times and the nonexclusive right to use common 23 areas, including parking areas. 24 3.~. The term of this lease is one year, beginning 25 April 1, 1987, and ending March 31, 1988. 26 4.~. The total rent of this lease is the sum of 27 THREE THOUSAND THREE HUNDRED DOLLARS ($3,300.00). City agrees 28 to pay Landlord said amount in installments of TWO HUNDRED 3/12/87 1 EXILe;! i1 1'~ o o o o 1 SEVENTY FIVE DOLLARS ($275.00) per month. City shall not be 2 liable for any other costs or expenses except as agreed to 3 herein. Monthly rental payments shall be made in advance and 4 mailed to 4214 North Sierra Way, San Bernardino, California 5 92407. 6 s. Use of Premises. The leased premises shall be used 7 as and for a community police center or for any other lawful 8 public purposes. 9 6. pavment of Utilities. City shall pay for all 10 electrical and telephone services furnished the premises for 11 the term of this lease. Landlord shall pay for qas, water, and 12 rubbish removal furnished the premises for the term of this 13 lease. 14 7. Dutv to Maintain and ReDair Premises. City shall 15 maintain all internal portions of the premises in qood 16 condition and shall keep windows and doors in qood repair. The 17 Landlord shall be responsible for the exterior of the 18 buildinq, except windows and doors. City shall be liable for 19 any damaqe to windows and doors and for any damaqe above 20 ordinary wear and tear to the interior of the premises 21 resultinq from the act or omission of the City or its 22 authorized representatives, but not from other persons. 23 8. Fixtures. city shall have the right to install such 24 fixtures as are necessary for the proposed use of the 25 premises, and such fixtures shall not become a part of the 26 real property. 27 9. ODtion to Renew. Landlord grants City an option to renew this lease for a period of one year after the expiration of its original term, on the same terms and conditions of this lease. city shall give Landlord written notice of its election to renew at least thirty days prior to the expiration of this lease. 11. Fire Insurance. Landlord agrees to procure and maintain in force during the term of this lease and any extension thereof, at its expense, fire insurance on the real property in an amount sufficient to protect Landlord's interests. 12. Sians. City may erect or display on the leased premises, any sign or advertising matter depicting the public use of the premises. 13. Office Furniture. etc. All office furniture and equipment, listed on the attached addendum, Exhibit 1 hereto, shall be included in the lease at no additional cost to city. Maintenance of the office furniture and equipment shall be at the expense of the City. 14. Hold Harmless. City shall hold Landlord harmless from all damages arising out of any injury to any person or property occurring in, on or about the premises, except the Landlord shall be liable to City for damage resulting from the acts or omissions of Landlord or his authorized representatives, and Landlord shall hold City harmless from all damages arising out of any damage caused by him or his authorized representatives. 3/12/87 3 o o o 15. Termination. City shall have the right to terminate this lease for any reason by giving two weeks' advance written notice to Landlord, and this lease shall terminate two weeks thereafter. 16. Amendment. This lease may be amended or modified only by written agreement signed by both parties and failure on the part of either party to enforce any provision of this lease shall not be construed as a waiver of the right to compel enforcement of such provision or provisions, nor act to release any surety from its obligations under this lease. 17. Notices.
