BACKGROUND
DuriDg the latter part of 1986, City, County and Norton Air Force Base officials
discuased the possibility of a joint-uae agreement by which Norton Air Force Base
llight accoiluaodate civilian sir operations without adverse iapact on ita lllilitary
operati0D8.
The first course of action was to secure a feasibility study. IPAC, Inc.
(International Plaill1ing and Analysis Center) subraitted a proposal cOlllprised of two
.. t,asks: .
Task I - investigste the potential demand for civilian air operations under
such a use. The types of c_rcial uae looked at were co_ter air lines
cOllllllercia1 air cargo, s88ll package ezpress and corporate aviation.

Task II - ualliue llilitary and civilian c0D8iderationa which will have a
bearing on this possible joint uae, such as: pOssible locations for
facilities, aro~nd access, secority considerations, air traffic and
compatibility with Air Force criteria. Task II also estiaated the costs to
accollllodate this joint use and those facilities that lllight qualify for
Federal Aviation Progr... funding.
The County paid h5,000 for Task I. The Agency authorized payment of Task II ia
the amount of .15,000 (B.eso 4940, 10/6/86). - \

In Decuber 1986 the consultants made a presentation to City and County officials
giving a variety of reasons why Joint uae of 'Norton would be beneficial and
feasible. Their report in written form was received and filed during this
presentation.
In order to pursue this concept, an airport pster plan is necessary. The
cQDsu1tant Tippetts-Abbett-McCarthy-StrattOn is recommending the use of their firm
in prepariDg and presenting an application for Airport Improvelllllnt Progr... (AIP)
grant 1IIOD1es to perfora this airport pster plan. Grant funds can pay for 90% of
the cost.
The fee for the service is *20,000 plus re1mburseab1e travel not to uceed
*3,000. The County has agreed .to one-half of this cost and is seeking Agency
approval for the other half -- approzimate1y *11,500.
The aervices to be performed under the Agrel!llent will include:

(1) Taking necesaary action to assure that Norton ArB is included in the National
Plan of Integrated Airport Systep and the State Airport Systeaa PlaD.

Attached is a copy of a report submitted by the County up1aiu1ng the formation-
and purpose of the Joint Use Study Committee. -
Staff recommends appointment of Mayor Wi1coz.
The term of the Agreement proposed is 45 days. At the end of this 45-c1ay period
the application will be 8ubllitted for approval.

JOINT USE STUDY COMMITTEE
The Joint Use Committee shall be comprised of a representative from the County of
San Bernardlno Board of Supervisors, representative of the City of San Bernardlno,
representative from the F.A.A., representative from the U.5o Air Force and an

at-large public member appointed by the City and County of San Bernardino
representatives. The Committee wW review and approve all processes for the
proposed joint use of Norton A.F.B. The Committee w111 elect a Chairman and
Vice-Chairman at Its flnt scheduled meeting. ThIs committee will function untll an
official Sponsorship Committee 11 formed.

In addition, to assist the Joint Use Study Committee, the previous "interim
SponlOnhlp Committee" 11 to be renamed the Joint Use Advisory Committee. The
C purpose of this committee 11 to provide Input, review and comments on the proposed
joint use, the Master Plan and E.LR. to the Joint Use Study Committee.

The Joint Use Study Committee may take the joint use proposal through the Master
Plan and E.LR. However, If a formal SponlOnhlp Committee 11 formed, the
Committee w111 be disbanded. However, If the Committee is disbanded before the
completion of the Master Plan and E.LR.. the Joint Use Advisory Committee will
remain In place to provide the same functions.

BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OP
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Chairman and Secretary of the Community
Development Commission of the City of San Bernardino are hereby
authorized and directed to execute for and on behalf of the
Redevelopment Agency of the City of San Bernardino an Agreement
between the County of San Bernardino, the Redevelopment Agedcy of
the City of San Bernardino and Tippets-Abbett-McCarthy-Stratton,
with such non-substantive changes to said agreement as may be
approved by the Chairman and Agency Counsel. A copy of said
agreement is attached hereto as Exhibit "1- and incorporated
herein by this reference as though fully set forth at length.

This AGREEMENT, entered into as of this
. 1987, by
of
the firm of TAMS hereinafter called "Consultant", the County of San Bernardino
(County). and the Redevelopment Agency of the City of San Bernardino (Agency).
hereinafter collectively called "Local Agency".
WITNESSETH
WHEREAS, Local Agency desires the services of a qualified Consultant to perform
the application process for planning projects for Norton AFB; and
WHEREAS, the Consultant is qualified and agreeable to render the aforesaid services.
as defined in Exhibit A;
NOW, THEREFORE, the parties hereto do mutually agree as follows:
I. FUNDING/PROGRAM MANAGEMENT
1. ENGAGEMENT
a. Local Agency hereby agrees to engage the Consultant and the
Consultant hereby agrees to perform services hereinafter set forth in
this contract, consistent with the scope of services presented in the
proposal to perform services which is set forth as Exhibit "A" and is

incorporated herein by reference. Consultant Is authorized to use
IPAC, Inc. as a subcontractor. Consultant shall be responsible for the
services and actions of its subcontractor.
b. Local Agency agrees to pay the Consultant a fee not to exceed $20,000,
as presented in the proposal, and reimbursable travel expenses not to
exceed $3,000.
Co County and Agency shall each be responsible for '096 of the contract
fees and travel expenses.
2. SCOPE OF SERVICES
a. The Consultant shall do, perform, and carry out, In a satisfactory and
proper manner, the services as indicated in Exhibit A.
3.
PERSONNEL
a. The Consultant represents that it has, or shall secure at its own
expense, all personnel required in performing the services under this
agreement. Such personnel shall not be employees of or have any
contractural relationship with Local Agency. Consultant shall be an
independent contractor In performing services under this agreement.

All service hereunder shall be performed by the Consultant or under its
supervision, and all its personnel engaged in the services herein shall be

fully qualified, and shaH be authorized under state and local law to
perform such services.
4.
METHOD OF PAYMENT
a. Payment to Consultant 11 due upon receipt by Local Agency of pre-
application documents.

b. The Consultant shall Invoice the County of San Bernardino on or after
payment due date.

c. Payment will be remitted to Consultant by County.

d. Agency shall reimburse the County for Its share of Local Agency cost
upon notice by the County.

e. All costs charged to this agreement by Consultant shall be supported by
properly executed payrolls, time records, Invoices, and vouchers,
evidencing in proper detail the nature and propriety of the charges.
6. AUDITS
At any time during normal business hours, as often as Local Agency
requires, the Consultant shall make available for examination, all of Its
records with respect of the performance of services under this agreement.
The Consultant agrees, for the purposes of audit and examination to make
o available excerpts, Invoices, materials, payrolls, personnel records,

conditions of employment, and other data relating to Consultant's
performance of services under agreement.
IL FEDERAL AND STATE MANDATORY
1. POLITICAL ACTIVITY
No portion of the funds received by the Consultant under this agreement
shall be used for political activity or to further the election or defeat of any
candidate for public office.
2.
PROHIBITED INTEREST
The Consultant agrees that it presently has no Interest and shall not acquire
any interest, direct or indirect, which would conflict In any manner or
degree with the performance of services required to be performed under this

agreement. The Consultant further agrees that in the performance of this-
agreement, no person having any such interest shall be employed.
3. GENERAL COMPLIANCE WITH LAWS
The Consultant will comply with all federal, state and local laws and
ordinances applicable to the work being performed.
IlL SPECIAL CONTRACT TERMINATION PROVISIONS
1. TERMINATION OF AGREEMENT FOR DEFAULT

If, through any cause, the Consultant shall substantially fail to fulfill, in a
timely and proper manner, its obligation under this agreement, or If the
Consultant fails to comply with any material provision of this agreement,
Local Agency shall thereupon have the right to terminate this agreement by
giving written notice to the Consultant of such termination and specifying
the effective date thereof. In the event such termination action is
performed, aU flnished or unfinished documents, data, studies, drawings,
maps, reports, or other related material prepared by the Consultant under
this agreement shall, at the option of Local Agency, become Local Agency's
property, and the Consultant shall be entitled to receive just and equitable
compensation for any satisfactory service completed on such documents and
other material.
2. TERMINA nON FOR CONVENIENCE
Local Agency or Consultant may terminate this agreement at any time by
giving written notice to the other party of such termination and specifying-
the effective elate thereof, at least thirty (30) days before the effective
elate of such termination. In that event, all finished or unfin1lhed documents
and other materials prepared under this agreement shall, at the option of
Local Agency, become its property. The Consultant will be paid a just and
equitable compensation for all satisfactory services completed.
3. In the event it is determined by the Local Agency that funding for the
planning grant is not available or otherwise feasible, this contract shall be
terminated in accordance with Paragraph 2 (above).

IV. CONTRACT EXECUTION AND AGREEMENT
I. TIME OF EFFECTIVENESS
This agreement shall go Into effect upon execution of this agreement by the
parties therein.
2.
CHANGES
Local Agency or Consultant may request changes in the scope of services,
time schedule for performance or rebudgetlng of funds during the course of
this agreement. Such changes, including any increase or decrease in the
amount of the Consultant's compensation, which are mutually agreed upon,
shall be Incorporated in written amendments to this agreement.
3.
DISPUTES
Except as otherwise provided in this contract, any disputes concerning a
question of fact arising under this agreement which 11 not disposed of by
mutual agreement shall be decided by a court of competent jurisdiction.
4. HOLD HARMLESS
The Consultant agrees to defend, indemnify and hold harmless local agency
and their offlcen and employees from and on account of any and all
liability, whether property damage and personal Injury, to the extent it

agreement.

INSURANCE
Throughout the term of this agreement, Consultant shall procure and
maintain insurance, including Workers' Compensation as required by law for
its personnel, and a one mill10n dollar ($1,000,000) commercial general
liabillty policy, combined single limit. Consultant shall Include Local
Agency as an additional named insured on this policy and shall provide Local
Agency with a certificate evidencing such coverage.
6.

Any notice required under this agreement may be personally served on the
other party or may be served by certified mail, return receipt requested, to

Norton AFB Planning Project Application Support
for
The County of San Bernardino

Backqround
This proposal is being submitted by Tippetts-Abbett-
McCarthy-Stratton and the International Planning and Analysis
Center, Inc. as a result of the December 1986 briefing to the
Board of Supervisors, the County of San Bernardino and the City
Council, the City of San Bernardino regarding the Norton APB
Joint Use Feasibility Study. During that briefing, follow-on
efforts were discussed. Specifically addressed was assistance
in obtaining Airport Improvement Program (AlP) planning project.
grant monies to perform an airport master plan and associated
requirements.
Airport master planning and noise compatability planning
for an existing airport are eligible for Federal matching grant
(AlP) funds of up to 90'. Normally, the additional 10' funding ~
is divided between State and local funding. The Department of ·
Transportation, Airport Improvement Program (AlP) Handbook
contains some specific comments regarding these two types of
plans, the latter normally being incorporated in the master
plan.
Airport Master Plans .....To be eligible for a
grant for master planning, an airport location
must be included in the first five-year period of
the current National Plan of Integrated Airport
Systems (NPIAS). In unusual circumstances, such
as the selection of a site for a new airport, a

m~ster planning project for an airport or
location included in the NPIAS for the second
five-year period may be allowed.
Airport Noise Compatability Plans. Airport noise
compatability planning includes the development
of noise exposure maps or a noise compatability
program or both in accordance with PAR Part 150.
Airport noise compatability planning may be
performed separately or as an integral part of an
airport master plan. In either case, noise
compatability planning and master planning are
closely related and neither can proceed without
taking into account its effect on the other.
The application process for planning projects includes a
pre-application conference between the Sponsor and the FAA,
preparation of the application forms, and issuance of a grant
offer by the FAA. This also would include, in the case of
Norton APB, actions to assure inclusion of the base in the
California State Airport Systems Plan, and the NPIAS,
coordination of all activities with the military, and necessaryt
clearing house coordination in accordance with Office of
Management and Budget Circular No. A 95. The clearinghouse
activities would include the Southern California Area
Governments (SCAG).
Purpose
The purpose of this proposal is to provide professional
service support by TAMS/IPAC to the County and City of San
Bernardino California during the process of obtaining Federal
grant master plan funds for Norton ArB as a joint use facility.

Specific tasks associated with the planning grant process
for Norton AFB are as follows:
1. Obtain documentation and take necessary action with
Regional, State and Pederal aviation authorities to assure that
Norton AFB is included in the National Plan of Integrated
Airport Systems and the State Airport systems Plan. This will
include contact with airlines (passenger, cargo, and commuter)
to obtain written statements Df interest in serving Norton APB.

2. Arrange for, develop presentation material for, and attend
the pre-application meeting with the FAA Regional Office
officials and the Sponsor. This will include a preparatory
meeting with the Sponsor.

3. Maintain contact throughout the grant process with Norton
AFB officials to ,be certain they are fully apprised of on-going
actions.
4. DevelOp Norton AFB specific information for and prepare the
..- application documentation necessary for obtainment of planning ~
IF- funds. This will' include: - ~
a. Standard Form 424, Federal Assistance, Sections I and
II, as prescribed in OMB Circular A-102.
b. FAA Form 5100-101, Application For Federal Assistance
(Nonconstruction Programs), Parts II, III, IV and V. Part
II is Project Approval Information which includes the terms
and conditions by which agency(ies) may act for the
Sponsor. Part III is Budget Information which includes a
breakdown of master plan costs by specific activities and
work elements. Part IV is the Program Narrative which
includes a detailed outline of each activity or work

5. Comply with the provisions of OMB Circular A-95 regarding
clearinghouse activities of Southern California Area
Governments and other governmental agencies. This will include
preparation of necessary documentation and presentation of
material required during the approval process.
6. Facilitate the Sponsor's review and approval of application
documentation for submittal to governmental agencies.
Deliverables
Deliverables under this contract are the application
documents and coordination required to assure application
success. This will include two meetings with the Sponsor and
the pre-application meeting with the Sponsor and the FAA.
Period of Contract

Terms of this contract will be completed within 45 days of ~
the notice to proceed exclusive of the time required for review
and approval by others.
Pees and Expenses
Professional service fees for the items covered in the
scope of work will be based on time expended, not to exceed
$20,000, payable upon invoice at the time of application
submittal. In addition, reimbursable travel expenses
(transportation, food and lodging) will be invoiced.
