Synopsis of Previous Council action:
11-17-8 Resolution No. 86-443 adopted expressing support in the relocation of
the Ventura Gulls, Class "A" Baseball Team to San Bernardino.
Council Ways & Means Committee reviewed proposed lease and directed
the City Engineer to proceed with preparation of the plans for the
Capital Improvements, and recommended CDBG Funds be allocated.
Resolution adopted authorizing execution of a lease with the San
Bernardino Spirit Class "A" Baseball Team for use of Fisca1ini Field.
Approval of Plans and Authorization to Advertise for Bids, Spec No. 7155.
All bids rejected and authorization granted to readvertise project.

STAFF REPORT
On Wednesday, February 11, 1987, bids on the project were opened for
the second time. The first bid opening on January 27, 1987, resulted in
three bids ranging from $74,444 to $109,920 and were considered too high
for award. Modifications were made in the plans and specifications and the
project readvertized.
The second bid opening resulted in three bids again, ranging from
$71,880 to $199,435. The low bid is 28.4% over the Engineer's Estimate of
$56,000.
Total project cost, based upon the actual low bid price, is estimated
to be as follows:

Funds to finance these costs are to be provided from CDBG funds and
the original funding requirement was set at $75,000.00. Because of the
nature of the project, it appears it will be very unlikely that the contin-
gency monies would be used. It appears that sufficient additional funds
could be obtained from the CDBG general contingencies fund, as needed. It
is recommended that provision of supplemental funds be deferred until the
project is completed and actual costs identified.
The first home game is scheduled for 4-10-87 and is to be a night
game; therefore, requiring lights. In view of this and in consideration of
the coordination requirements with the other aspects of the project, we
recommend that the contract be awarded.
URGENCY CLAUSE
The proposed work is necessary prior to completion of other aspects of the
project. The first usage of the facility is scheduled for 4-10-87 and all
remaining time is required for construction of the improvements.

2 ' RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO
G D M ELECTRICAL CONSTRUCTION, INC. FOR UPGRADE OF BALLFIELD LIGHTING FOR
3 FISCALINI FIELD IN PERRIS HILL PARK.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

SECTION 1. G D M Electrical Construction, Inc. is the lowest
6 responsible bidder for upgrade of Ballfield Lighting for Fiscalini Field in
7 Perris Hill Park, in accordance with Plan No. 7185, for the total amount of
8
$71,880.00, a contract is awarded to said bidder accordingly, but such award
9 shall be effective only upon the contract being fully executed by the parties;
10 all other bids therefor are hereby rejected; and the Mayor is hereby authorized
11 and directed to execute said contract on behalf of the City; a copy of the
12 contract is attached hereto, marked Exhibit "A" and incorporated herein by
13 reference as fully as though set forth at length.

SECTION 2. Execution and Amendments. This contract and any
15 amendments or modifications thereto shall not take effect or become operative
16 until fully signed and executed by the parties and no party shall be
17 obligated hereunder until the time of such full execution. No oral
18
agreements, amendments, modifications or waivers are intended or authorized
19 and shall not be implied from any act or course of conduct of any party.

I HEREBY CERTIFY that the foregoing resolution was duly adopted
