STAFF REPORT
Staff and Redevelopment Committee recommend that the Director of Public Works be
authorized to construct a dip section on 48th Street at Devil's Canyon Diversion
Channel (near Kendall) and that the Redevelopment Agency reimburse the City for
said cost up to $220,000.
BACKGROUND
The City has recognized the need for the construction of a dip section where 48th
Street meets with Devil's Canyon Diversion Channel.
Recently the City placed a condition of spproval on an adjoining deVelopment for
the payment of $10,000 towards this crossing. The adjoining deVelopment is for 84
multi-family units to be constructed by Covington Homes at Devil's Canyon Flood
Control Channel and Little Mountain Drive.
Roger Hardgrave has prepared a preliminary cost estimate based upon the
installation of 4, 36" pipes to carry normal flow. This estimate is attached as
well as a map of the area involved.
Redevelopment CollllDittee reviewed the matter on February 5, 1987 and recolDIDends
that the Agency enter into an agreement with the City for Public Works to solicit
bids and construct the dip section required. The cost of $220,000 to be borne by
the Agency from State College tax increment.

Attached, in response to your request, is a copy of the preliminary
estimated cost for constructing a dip section. This estimate is based
upon installing 4, 36-inch pipes to carry normal flows.
The Flood Control District has indicated they would offer no objection to
construction of this type of facility. We have requested that they provide
a letter to this effect. .
Please advise if you desire any further information.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. The Mayor of the City of San Bernardino is hereby
7 authorized and directed to execute on behalf of said City an
8 agreement with the Redevelopment Agency of the City of San
9 Bernardino relating to street construction services in the State
10 College Project Area, a copy of which is attached hereto, marked
11 Exhibit -A- and incorporated herein by reference as fully as
12 though set forth at length.

SECTION 1. The Chairman and Secretary of the Community
Development Commission of the City of San Bernardino are hereby
9 authorized and directed to execute for and on behalf of the
10 Redevelopment Agency of the City of San Bernardino an agreement
11 with the City of San Bernardino relating to street construction
12 services in the State College Project area, with such non-
13 substantive changes to said agreement as may be approved by the
14 Chairman and Agency Counsel. A copy of said amendment is attached

3 THIS AGREEMENT, effective as of the ,day of February,

4 1987, by and between the CITY OF SAN BERNARDINO, ..unicipal
5 corporation, hereinafter .City,. and THE REDEVELOPMENT AGENCY OF
6 THE CITY OF SAN BERNARDINO, a public body corporate and politic,
7 hereinafter .Agency,. sets forth the undertakings of the parties
8 concerning construction of certain street improvements within the
9 State College project Area.
10 City agrees to forthwith undertake the planning for, design
11 of and letting of contracts for the construction of certain
12 improvements to 48th Street at the point where said street crosses
13 the Devil's Canyon Diversion Channel, to correct an existing dip
14 in 48th Street which constitutes an impediment to further
15 development and redevelopment of the area served thereby. City
16 shall be solely responsible for the planning, design, engineering,
17 construction, contract administration, and all other phases of the
18 public improvements contemplated herein.
19 Agency agrees to reimburse to City, upon billing therefor,
20 from time to time, as services are rendered and as expenses are
21 incurred, all expenditures incurred for such design, planning and
22 construction of improvements, presently estimated at $220,000,
23 less any contribution applicable thereto from other developers
24 adjacent to the site, or otherwise obligated to contribute to the
25 regional improvements contemplated hereunder~ Agency's obligation
26 hereunder shall be limited to $220,000.
27 City shall keep Agency fully informed as to the progress in
28 the planning, design, letting of contracts and actual construction

1 of the public improvements covered by this agreement. Agency
2 approval is not required for any phase of the project, and City
3 assumes full responsibility for the manner in which the project is
4 carried out. Agency's sole and only obligation hereunder is to
5 reimburse costs to City, up to the sum of $220,000.
