STAFF REPORT
A request was received to vacate that certain East/West alley
South of 4th Street, East of Allen Street, from the owners who
adjoin the portion to be vacated relative to an existing
development. This request represents 66% of those owners who
adjoin the alley.
All the interested Ci ty Department Heads and the Util i ty
Companies were notified of the proposal on September 5. 1986,
with a reply due on October 3, 1986. The utility companies
have responded and no reservations for pUblic utility easements
were requested.
The Planning Department has responded and indicates that
"...the proposed vacation...was recommended for approval".
This particular alley has improvements, consisting of a block
wall and car ports, existing on it. Adjoining property owners
have conveyed their interest in subject alley to the
petitioner. The Housing Authority, one of the adjoining
owners, has al so submi tted a letter of agreement to the
vacation.
The proponents have been notified by letter on October 30,
1986, and have responded with notification for us to proceed.
The required $400.00 fee has been paid and it is, therefore,
recommended that favorable consideration be given to the
requested vacation.
The Resolution of Intention, which sets a protest date of March
16. 1987, has been attached hereto for your action also.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING
ITS INTENTION TO ORDER THE VACATION OF THAT CERTAIN EASTIWEST
ALLEY SOUTH OF 4TH STREET, WEST OF ALLEN STREET.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That the Mayor and Common Council of the
Ci ty of San Bernardino hereby declares its intention to order
the vacation of that certain East/West alley South of 4th
Street, West of Allen Street, in said City, which said portion
is more particularly described as follows:
That portion of that certain East/West alley
adjoining Lots 1, 2, 3, 4, 5 and 6, Block 'C.,
Wozencraft Place Tract, as per map recorded in
Book 5 of Maps, page 47, records of. the County
Recorder of San Bernardino County, State of
California, described as follows:
Beginning at a point on the South line of said
Lot 1, said point being a distant 2 feet East
of the West line of said Lot 1; thence East
along the South lines of said Lots 1, 2, 3, 4,
5, and 6 to the Southeast corner of sai d Lot 6;
thence South along the Southerly prolongation
of the East line of said Lot 6, a distance of
10 feet to the Northerly line of Parcel 2 of
Parcel Map 7140 as per map recorded in Book 40
of Parcel Maps, pages 1 and 2, records of said
County; thence West along said North line to
the Northwest corner of said Parcel 2; thence
North along the Northerly prolongation of the
West line of said Parcel 2, to the Point of
Beginning.
SECTION 2. That the Mayor and Common Council of the
City of San Bernardino, in vacating the above described portion
of said alley, elects to proceed under and in accordance with
the provisions of the "Public Streets, Highways and Services
Vacation Law". being Division 9, Part 3, of the Streets and
Highways Code of the State of California.

SECT ION 3. Tha t the hour of 9 :00 A.M. on the 23rd day
of March, 19B7, in the Council Chambers, City Hall. San
Bernardino, Cali fornia, be, and the same hereby is fixed as the
time and place when and where all persons interested in or
objecting to the proposed vacation may appear before the said
Mayor and Common Council and offer evidence in relation
thereto. For further particulars as to the proposed vacation
of the hereinbefore described alley, reference is made to that
certain map marked "Plan No. 7075" approved February 16. 19B7.
on fi le in the offi ce of the Ci ty Clerk of said Ci ty.
SECTION 4. That the City Engineer of the City of San
Bernardino hereby is directed to cause Notices of Street
Vacation to be posted as required by the "Public Streets.
Highways and Services Vacation Law".
SECTION 5. That the City Clerk shall certify to the
adoption of this Resolution of Intention and shall cause the
same to be published once a week for two successive weeks in
The Sun, a newspaper published and circulated in the City of
San Bernardino, prior to the date of the above public hearing.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a meeting thereof held on the
