CITY OF SAN BERNO:IDINO - REQUEST .QR COUNCIL ACTION STAFF REPORT A request was. received by this office to vacate the alley South of Baseline, between Sepulveda and Wall, from three of the adjoining property owners. This request represents more than 75% of those owners who adjoin the area proposed for vacation. On 11-07-88, authorization was given to proceed with the proposed vacation, and Plan No. 7621 was approved. All of the concerned City Departments and Utility Companies were notified of the proposal on 01-31-89, with a reply due by 02-24-89. The responses are attached for your information. A reservation of an easement for General Telephone was requested, along with a request for a reservation of an easement for Comcast Cable Company, which will have to be reserved, as set forth in the attached Resolution of Intention. On 04-03-89, a Negative Declaration was adopted and a finding of consistency with the General Plan was made. This vacation proceeding has been postponed twice, once to make sure that there was no problem with trash service to property owners. adjoining the alley, and the second time so the concerned owners coul d check as to ownershi p of the property in question. The remaining fee of $200.00 has been paid and it is recommended that favorable consideration be given to the requested vacation. The Resolution of Intention, which sets a protest date of 10-16-89 has been attached hereto for your action also. A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF THAT CERTAIN ALLEY SOUTH OF BASELINE, BETWEEN SEPULVEDA AND WALL, AND RESERVING AN EASEMENT FOR GENERAL TELEPHONE COMPANY AND APPURTENANT FACILITIES, AND AN EASEMENT FOR PUBLIC UTILITIES THEREIN. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of tha t follows: 11 12 13 14 15 16 17 18 That certain East / West alley, located South of Baseline Street, between Sepulveda Avenue and Wall Avenue, in the City of San Bernardino, County of San Bernardino, State of California, described as follows: Beginning at the Southwest corner of Lot 1 of Block "A" of W.J. Wilseys' Base Line Addition, as per map recorded in Book 5 of Maps, page 27, in the office of the County Recorder of said County, said point also being the East line of Sepulveda Avenue, 60 feet wide; thence East, along the South lines of Lots 1, 2, 3, 4, 5, and 6 of said Block "A", a distance of 300 feet, more or less, to the Southeast corner of said Lot 6, said point also being the West line of Wall Avenue, 60 feet wide; thence South, along the Southerly prolongation of the East line of said Lot 6, a distance of 16.5 feet, to the Northeast corner of Lot 2 of Block "B" of said Wilseys' Base Line Additi on; thence West, along the North li nes of Lots 2 and 1 of said Block "B", a distance of 300 feet, more or less, to the Northwest corner of Lot 1 of said Block "B", said point also being the East line of said Sepulveda Avenue; thence North, along the Northerly prolongation of the West line of said Lot 1, a distance of 16.5 feet to the Point of Beginning. 19 20 21 22 23 24 Bernardino, 25 26 SECTION 2. That the hour of 10 :00 A.M. on the 16th day of October, 1989, in the Council Chamber of the Ci ty Hall, San Bernardino, 3 California, be, and the same hereby is fixed as the time and place when and 4 where all persons interested in or objecting to the proposed vacation may 5 appear before the said Mayor and Common Council and offer evidence in 6 relation thereto. For further particulars as to the proposed vacation of 7 the hereinbefore described portion of said streets, reference is made to 8 that map marked "Plan No. 7621" approved November 7, 1988, on file in the 9 office of the City Clerk of said City. 10 SECTION 4. Nothing in this Resolution shall in any way affect or 11 disturb any existing easements for sanitary sewer and appurtenant facilities 12 and an easement for public utility purposes belonging either to the 13 City of San Bernardino or to any pUblic utility and there is hereby 14 reserved for future general public utility purposes and for this City an 15 easement reasonably necessary to locate such publi c utility faciliti es 16 over, in, under or across the real property hereinabove described and to 17 use, maintain, repair, replace or renew such facilities. There is also 18 reserved for General Telephone Company, an easement to construct, place, 19 operate, inspect, maintain, repair, replace and remove such aerial and 20 underground telephone communication structures as it may require, consisting 21 of poles, anchors, wires, cables, conduits, manholes, markers and necessary 22 fixtures and appurtenances. 23 SECTION 5. That the City Engineer of the City of San Bernardino is 24 hereby directed to cause Notices of Street Vacation to be posted as 25 required by the Public Streets, Highways and Services Vacation Law. 26 SECTION 6.
