ORDINANCE OF THE CITY OF SAN BERNARDINO ESTABLISHING AN INTERIM MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS IN THE VERDEMONT AREA UNTIL AN ACCEPTABLE PLAN OF FINANCING THE CONSTRUCTION OF THE BASIC PUBLIC WORKS INFRASTRUCTURE IS ASSURED, AND DECLARING THE URGENCY THEREOF. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Purpose: Pending further study and the adoption of measures to assure the financing and construction of adequate public works infrastructure in the Verdemont Area, it is necessary, on an interim basis, to prohibit the issuance of any building permits for projects in the Verdemont Area. SECTION 2. Verdemont Area Defined: That area of the City of San Bernardino delineated by the Verdemont Area Plan adopted by the Mayor and Common Council in November 1986. SECTION 3. Moratorium: Beginning on the effective date of this ordinance, and continuing for sixty (60) calendar days thereafter, unless action is taken by the Mayor and Common Council to shorten or extend the term of this ordinance, no building permit shall be issued for any projects in the Verdemont Area. SECTION 4. Exemptions: The issuance of building permits for the repair or construction of a single family home, if applied for by the owner-occupant or his agent, shall be exempt from the terms of this urgency ordinance. SECTION 5. Urgency: This ordinance is an urgency measure necessary for the immediate preservation of the public peace, health and safety and shall become effective immediately upon its adoption and approval. Currently public facilities and public services are over-burdened and over-capacity. B. Existing streets are substandard and existing traffic conditions are unsafe. C. Present street lighting is inadequate, causing an increase in crime and dangerous conditions. D. Because of a lack of sewers, there is greater potential for groundwater contamination. E. There is presently an inadequate supply of safe potable water. F. There are inadequate water systems for fire suppression. G. Because of the lack of sidewalks there is unsafe pedestrian access. H. Because of an incomplete street system, emergency vehicles provide increased response time. I. Unless the issuahce of building permits are temporarily halted and until the City adopts legislation and programs to assure that adequate public works infrastructure are financed and constructed, the above urgency conditions will worsen.
