Recommended motion:
1. That the Director of Public Works/City Engineer and the City Clerk are
authorized to proceed with the proposed vacation of that portion of "J"
Street, between Oak Street and a point approximately 355 feet North thereof.
2. That Plan No. 7881, showing the proposed vacation of a portion of "J" Street,
North of Oak Street and a point approximately 355 feet North thereof be

STAFF REPORT
A request was recei ved from Frank Si 1 vei ra, an adjoi ni ng property owner, on
August IS, 1989, to vacate the remaining portion of "J" Street, North of Oak
Street and South of the portion South of Lytle Creek Channel, which was recently
vacated. Mr. Si 1 vei ra bought the property adjoi ni ng the requested vacation
approximately four months ago, too late to join the previous street vacation
proceedings. This request represents 33% of those owners who adjoin the street.
The petitioner has deposited the required $200.00, which represents one-half of
the total fee of $400.00. The remaining $200.00 will be due after the
investigative proceedings.
"J" Street in this area is unimproved. Richardson Junior High School's fence
abuts the West side of "J" Street. The school does not use "J" Street for
access. The petitioner would like this portion of "J" Street vacated to
alleviate the dumping of trash along and on his property. "J" street to the
North of the proposed vacation was recently vacated from approximately 355 feet
North of Oak Street to the Lytle Creek Channel, and the vacating of this
remaining portion would effectively vacate all that portion of "J" Street between
Oak Street and the Lytle Creek Channel. There are only three property owners
affected by the proposed vacation.
As this vacation would relieve the City of responsibility and maintenance
problems for the section of "J" Street North of Oak Street, staff therefor
recommends that the Director of Public Works/City Engineer and the City Clerk be
authorized and directed to proceed with the proposed vacation. .
