CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
The attached memorandum (exhibit "A") from the City Attorney
was approved by the Council Personnel Committee at its July
20, 1989, meeting, to increase the salary ranges for the
positions of Assistant City Attorney (from Range 4176 $4686-
5706/mo. to Range 4184 $5173-6300/mo.) and Senior Assistant
city Attorney (from Range 4184 $5173-6300/mo. to Range 4192
$5706-6959/mo.). The attached resolution amending Resolution
6413, Section 14, reflects the new salary ranges and steps
for these two positions.

Adjustment of Salary Ranges (Assistant and Senior
Assistant City Attorney) and promotion of Deputy City
Attorney III
As the Committee is aware, we have worked very hard in the
last two years to assemble and maintain a dedicated, competent
legal staff in the City Attorney's Office, which we now feel is
one of the finest law firms in the area.
As we advised the Committee by memo dated March 22, 1989,
the approval by the Council of the creation of the position of
Senior Deputy City Attorney created a salary compaction with the
position of Assistant City Attorney. When that position was
created, we advised the Council that we would come back shortly
to resolve that situation. In addition, the Senior Assistant
City Attorney is at the top of his salary range and the Assistant
City Attorney is at the next to the highest step in her salary
range. Both of these individuals are highly skilled in their
areas of expertise and have been recruited by other pUblic
agencies. In order to retain their services for the. City, we
need to provide them some possibility of future increases.
It is therefor recommended that the Assistant City Attorney
be moved from D Step of Range 4176 ($5,433 per month) to C Step
of Range 4184 ($5,706 per month). In addition, it is recommended
the Senior Assistant City Attorney be moved from E Step of Range
4184 ($6,300 per month) to C Step of Range 4192 (no change in
monthly salary). This will allow both of these attorneys to
have the potential of two more annual merit increases. We have
attached a copy of a study of the corresponding salaries of
jurisdictions similar to ours for your review and comparison.

We also have noted that with the tremendous workload in the
area of Planning during the past year on the General Plan and the
Planning related litigation, Mr. Henry Empefto has worked far
above his designated Deputy City Attorney III level. He has
shown commitment, dedication, leadership and initiative
consistent with what is expected from a Deputy City Attorney IV.
It is therefore recommended that Mr. Empefto be promoted to that
level at the B Step. The following is a comparison of the
current and proposed salary ranges for Mr. Empefto:
