At the Council meeting of 7-5-89, this item was continued until
10:00 a.m. on 8-21-89. The reason for this continuance was to
afford sufficient time for us to meet with the five protestors
and negotiate a solution for their concerns.
The protests were based upon the concerns that large delivery
trucks would find it more difficult to gain access to abutting
properties. At the meeting with the property owners on 6-30-89,
different options to alleviate these concerns were discussed.
The only option that appeared to have any possibility of being
accepted was the construction of loop connector streets along
both sides of the railway, as shown on the attached plan.
We have been in contact with the persons that have registered
protests. Below is a summary of these negotiations.
1. Mrs. Laverne Zu1ch, 3520 Broadmoor Boulevard --
Mrs. Zu1ch owns the Zulch Auto Works, on the southwest corner
of Third Street and "I" Street. This business has access to
both adjoining streets, so vacation of the Broadway Street
and Main Street would not have any impact on this business.
The parcels south of Broadway Street, and west of "I" Street,
are also owned by Mrs. Zulch, who has leased them for an auto
impound yard. These properties have access to "I" Street, so
they also would not be affected by the proposed vacations.
A meeting was held with Mrs. Zulch, and Mr. Ed Jacobsen, on
7-19-89. Mrs. Zulch was concerned about the impact that
acquisition of 20 feet would have on the operation of the
impound yard. She agreed to submit a preliminary estimate of
cost for acquisition of the rights of way for construction of

the connector streets. She also owns the vacant parcel on
the west side of the railway. This estimate has not been
received.
Mrs. Zulch indicated that construction of the connector roads
would not be a sufficient inducement for her to withdraw her
protest. She was also concerned over the railroad spur to
the east of the main line. The tracks for this spur line
have been removed north of the south right of way line at
Main Street.
2. Mr. Carl Oldenkamp, 10225 Sage Hill Way, Escondido --
Mr. Oldenkamp owns the Allgood Shower Door Company. There is
a sales office east of the railway, and a manufacturing plant
to the west. Most deliveries to the plant are through the
shipping and receiving door on the north side of the
building, adjoining the parking lot that takes access from
Third Street. Some deliveries of bulk materials are
accomplished through a door in the south side of the
building. However, the parcel to the west of the plant is
also owned by Mr. Oldenkamp and is vacant. This parcel will
afford maneuvering room for the few delivery trucks that
unload through the door along Broadway Street.

3. Mr. Stanley Lang, 950 West Second Street --
Mr. LQng owns the LQng's Empire Building Materials, east of
the railway and south of Main Street. About a year ago, a
fire severely damaged the building for this business. Mr.
Lang is still negotiating a settlement with his insurance
company. Meanwhile, Mr. Lang has leased the lot owned by Ms.
Jean Conrey, west of the railway, in order to allow him to
continue in his business operations.
Mr. LQng's protest is based upon the fact that forklifts used
for his business traverse the Main Street crossing, while
traveling between his property and the parcel leased from Ms.
Conrey. Also, that closure of the crossing would render
delivery of materials more difficult. Traversal of the
crossing by the forklifts is an interim situation, and will
be terminated upon reconstruction of his fire damaged
building.

4. Ms. Jean Conrey, 914 S. Eureka Street, Redlands -_
Ms. Conrey's concerns are basically the same as her tenant,
Mr. LQng.
5. Mr. Dean Meyers, 982 W. Second Street
Mr. Meyers operates a screen company on property between the
railway and "J" Street, and is concerned about accessibility
to the rear of his property by delivery trucks. It is our
understanding that these trucks are about 30 feet in length,
and most likely 3 axles. These trucks are very maneuverable,
and we expect that the drivers could back the trucks the
short distance down Main Street from "J" Street. Also, there
is a dirt area west of the railway that is used as a turn-
around.
The loop connector street, along the west side of the
railway, would satisfy Mr. Meyer's concerns. Therefore, Mr.
Meyers is willing to withdraw his protest, contingent upon
the loop connector street being constructed.
The vacation of these crossings was originally proposed in order
to secure Santa Fe's approval of the new "F" Street Grade
Crossing for the Central City South Project. However, there are
no automatic protection devices for these crossings and there are
some serious sight restrictions. This renders the issue to be
also a traffic safety matter.
Santa Fe's policy, of requiring an existing grade crossing to be
closed in order to secure their approval for a new crossing, has
been discussed with Mr. Roy Smith, Manager - Special Projects,
Western Region. Mr. Smith confirmed that this is Santa Fe's
established policy and offered no hope in getting an exception.
We have also verified that Santa Fe would require the crossings
to be physically closed upon vacation.
The resolution ordering the vacation will be conditioned upon the
Public Utili ties Conunission approving our application for a new
grade crossing on "F" Street, and will be finalized prior to
opening the new grade crossing to public traffic. This process
will defer the actual closing of the Main and Broadway Crossings
for about a year.
Construction of the loop connector streets would only satisfy one
party that has filed a protest. We do not feel the cost is
justified for one party; and, therefore, are unable to reconunend
this option.

The issue of fire protection was raised at the Council meeting of
7-5-89. The proposed vacation of these grade crossings has been
reviewed by our Fire Department, who has determined that this
action would not adversely affect fire protection. There is a
fire hydrant on the south side of Main Street, west of the
railway. Hoses could be laid across the tracks in the event of a
fire east of the railway.
After carefully reviewing each of the above situations, we
believe that vacation of these crossings would not significantly
impact these businesses. Therefore, we reconunend the following
form motion be adopted:
MOTION:
That the protests be overruled, the hearing closed, and the
Findings of Fact, as set forth in the Staff Report dated 9-30-88,
from Roger G. Hardgrave, Director of Public Works/City Engineer,
as to why portions of Main Street and Broadway Street, between
"I" Street and "J" Street, are no longer necessary for street and
highway purposes, be adopted.
Please advise if you would like to discuss this proposed
vacation.

STAFF REPORT
INTRODUCTION
At the meeting of October 24, 1988, the Mayor and Common Council directed Staff to bring
back a report on alternate crossings which might be more appropriate candidates for
closure than Main Street and 8roadway Street. This action was taken in response to
protests received from the adjoining property owners.
All grade crossings with Santa Fe Railway lines were reviewed to determine if there were
any that could be considered a candidate for closure. The only other possibility was
found to be Ennis Street.

DISCUSSION
a) Ennis Street (See Attachment "A")
Ennis Street is 40' wide (right-of-way) serving as a collector between Washington
Avenue and Waterman Avenue. The crossing is located about 0.4 mile South of Central
Avenue and 0.2 mile North of Dumas Street.
Currently, Enni s Street is a 2-lane paved road. Some short reaches have been
improved with curb and gutter. The ultimate cross section is 40' curb-to-curb with
a 60' right-of-way. The area is about 25% occupied by residential and small
commercial developments.
Closure of Ennis Street would impact approximately 112 acres of land as shown on the
attached map. The most adversely impacted properties would be those immediately
West of the crossing. Under the worst situation, motorists would have to travel an
extra 1/4 mile to get to the intersection of Central Avenue and Waterman Avenue.
Accessibility of the area would be reduced for emergency and public service
vehi c"1 es.
The Ennis Street crossing will be needed in the future as a trade, to obtain
approval for a new grqde crossing, when construction of the new East/West arterial,
to align with Orange S~ow Road and Pioneer Street, is constructed.
Closure of the Ennis Street crossing would adversely affect growth potential of the
area. Approximately 25% of the area could suffer major adverse effects on growth
potential.
b) Broadway and Main Streets (See Attachment "B")
Broadway Street and Main Street are only 20' wide (right-of-way) each and function
as alleys. There are no plans to widen either one to full street standard width of
50' (right-of-way).
The area that would be impacted, if these alleys are closed, is approximately 8
acres of residential and commercial land.

In the worst case, properties West of the crossings would be 0.1 of a mile further
from the intersection of 3rd Street and "I" Street. Emergency and public service
vehicle access would be reduced accordingly. Closure of these crossings could
adversely affect the redevelopment potential of this blo,ck; however, due to the
small size of the area and close proximity of a major street, the impact would be
minor.
Consi derati on coul d be gi ven to constructi ng loop streets between Broadway Street
and Main Street in order to avoid "dead ends','.
CONCLUSION:
1. Closure of the Ennis Street crossing may adversely affect emergency services, public
services, and development potential of approximately 30 acres of partially developed
lane West of the crossing.
2. The Enni s crossi ng wi 11 be needed for 9 trades to obtai n a future crossi ng for a
Master Plan East/West arterial to align with Pioneer Street and Orange Show Road.
3. Closure of the crossings on Broadway and Main Streets may have minor adverse impacts
on about 4 acres of developed land West of the crossings, but these impacts would be
substantially less than the impacts of closing Ennis Street.
RECOMMENOAT ION:
That the City proceed with the closing of the Broadway Street and Main Street crossing
of the A.T. & S.F. Railroad.

Upon receiving a request from the Redevelopment Agency to vacate portions of Main
Street and Broadway Street, between "I" and "J" Streets, authorization was given on
02-01-88 to proceed with the proposed vacation, and Plan No. 7422 was approved.
On 08-01-88, a finding of need for health and safety reasons was made, the
DeclaraU on was adopted and a finding of consistency with the Interim Policy
was made.

public grade crossing over the Santa Fe Railway. Sanla Fe has indicated that they
w01l1d consider approving the new public grade crossing, provided that a present
crossing(s) is closed. Main Street and Broadway Street are minor crossings and were
selecled as possible candidates t.o be closed.
