Synopsis of Previous Council action:
12-23-87 -- Ordinance No. MC-614 adopted to provide that all new
development shall connect to the City sewer systems,
with certain exceptions.
06-05-89 -- Ordinance No. MC-663 adopted, providing additional
exceptions to requirement to connect to City sewer
system.
Recommended motion:
That the request from Mr. Robert Carrillo, for a waiver of the
requirement to connect to the City sewer system for 4351 west
Meyers Road, be approved.

STAFF REPORT
A request has been received from Mr. Robert Carrillo, by
letter dated 7-14-89, for a waiver of the requirement for 4351
West Meyer Road to connect to the City sewer system. A copy of
this letter is attached for reference.
This request is based upon the fact that the parcel is 5
acres, and located about two miles from the City sewer system.
Ordinance No. MC-663 states that the Mayor and Council
may waive or modify the requirement to connect to the City sewer
system, where one or more of 4 conditions exist. One condition
is that a single family residential development will be built
upon a lot larger than one-half acre, and there is a natural
obstruction that prevents the practical extension of a sewer
line to serve the development.
Mr. Carrillo plans to build a 1750 sq. foot residence on
the 5 acre parcel. Extension of a sewer line to serve this
development would entail crossing Meyers Creek. Therefore, this
condition for granting a waiver is satisfied.
We recommend that the request for a waiver be approved.

Honorable Mayor , Councilmembers:
I am hereby requesting a waiver of sewer requirements on my
property, located at 4351 W. Meyers Rd., legal description,
Parcel 2 of Parcel Map # 5248 as per county of S.B. book 55,
pages 100-101.
My property is a five acre parcel, on which I plan to build a
home for my residence of approximately 1750 square feet.
The city's current requirement on my project is to bring city
sewer service approximately 2 miles or more. In accordance
with your Ordinance IMC-663, I am hereby requestinq a waiver
on the followinq basis: The proposed sinqle family residence
will be built upon a lot larqer than one-half acre, and there
is a natural obstruction, such as a hill and adverse qrades
that prevents the practcal extension of a sewer line to serve
me residence. Also, the extension of a sewer line would
simply result in my beinq financially incapable of ever
building my home. This cost would be hundreds of thousands of
dollars.
Also, none of the existing residences in the area currently
have sew~r, even the later developments built in the past few
years.
I hereby request your favorable decision reqardinq this
matter, and solicit any help you can give.
