The City Team and the San Bernardino City Professional Firefighters, Local 891, reached tentative agreement on amending the Memorandum of Understanding on September 4, 1996. The agreement outlined below and described in Exhibit A is subject to ratification by the Firefighters and approval by the Mayor and Common Council. 1. Extending the current MOU from August 31, 1996, to December 31, 1996, thus revising Article 48, Term. All current terms and conditions remain in effect, except as noted in 2 and 3 below. 2. Granting 96 hours of time off in the aggregate through December 31, 1996, for employees elected to the union board, to perform official functions, with no carry-over of time not used, thus revising Article 16, Leave Provisions. 3. Implementing non-economic, tentative agreements reached to date: Amending Definition of Terms; Article 1, Recognition; Article 6, Wages; Article 11, Sick Leave; Article 20, Paramedic Assignment; Article 23, Work Uniforms; Article 45, P-lIP-2 Reclassification (attached) . 4. Resuming contract negotiations in mid-November 1996. It is understood that the revision of Article 16, Leave Provisions, for union board members is on a one-time basis only. It is agreed that the issue of the employee's last day is resolved administratively. It is also understood that an agreement to reorganize the MOU articles will be implemented following completion of contract negotiations, to resume in mid-November 1996. RECOMMENDATION Adopt resolution. (',-- '- c.. r '- SIDE LETTER TO FIRE SAFETY EMPWYEFS' MEMORANDUM OF UNDERSTANDING This letter and attachments set forth the agreement made on September 4, 1996, between the City and the San Bernardino City Professional Firefighters, Local 891, relative to: 1. Extending the current MOU from August 31, 1996, to December 31, 1996, thus revising Article 48, Term. All current terms and conditions remain in effect, except as noted in 2 and 3 below. 2. Granting 96 hours of time off in the aggregate through December 31, 1996, for employees elected to the union board, to perform official functions, with no carry-over of time not used, thus revising Article 16, Leave Provisions. 3. Change Employee Oreanization to read: San Bernardino City Professional Firefighters, Local 891. Article 1. Recoenition Change the last sentence to read: Firefighters, Paramedic/Firefighters, Fire Engineers, Fire Investigators and Fire Captains of the San Bernardino Fire Department. Article 6. Wal!:es Change first sentence in A. to read, " . . . in classifications of Firefighter, Paramedic/Firefighter, Fire Engineer, Fire Investigator and Fire Captain." Article 11. Sick Leave Delete sentence reading, "An employee may not use accumulated sick leave in conjunction with an industrial injury." Article 20. Paramedic Assi~nment (non-monetary language) Revise the first two (2) paragraphs to read as follows: "Pay for paramedic duty shall be paid to P-2 Paramedic/Firefighters certified as active by the Fire Chief. " Delete sentences two and three in first paragraph of Article 20. Delete "assignment pay" listed by "year" and "amount" in second paragraph of Article 20. Article 23. Work Uniforms The issue of Safety Boots was discussed at a Labor Management Committee meeting on 8/6/96. The City Team's response is that the Firefighters' request may be implemented administratively, and that language on this issue does I!Q1 need to be included in the MOU. I'~ . '-' ,... "- Article 45. P-I/P-2 Reclassification Delete this Article, referencing a one-time reclassification bonus for eligible P-I's being reclassified to P-2 Paramedic/ Firefighters. Employee's T <l.t Dl\)' This issue was discussed at a Labor Management C()mmittee meeting on 8/6/96. The City Team believes current practice responds to the Firefighters' request for being placed on a day shift on his/her last day of duty, that the request may be implemented administratively, and that language on this issue does nQ! need to be included in the MOU.
