Proposition 209 is the mirror image of the racially and gender divisive legislation, Assembly Constitutional Amendment 2 (ACA 2), that was defeated in the California State Assembly in 1995. However, these same proponents of ACA 2 have now succeeded in campaigning to have Proposition 209 appear on the ballot by way of the initiative process. 1. Proposition 209 will dismantle and prohibit the implementation of voluntary affirmative action programs that have served to remedy issues of under-utilization of women and minorities in City of San Bernardino employment; 2. It will eliminate efforts to ensure that women-owned. minority-owned and disadvantaged-owned businesses have equal access and participation in the awarding of City contracts; 3. Proposition 209 will prohibit the community college and the state university in San Bernardino from using recruitment and admission policies that strive to achieve diversity in their student population and ensure equal access for women and minorities into schools of higher learning; .O~64 "'- C,TY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT 4. Proposition 209 as a proposed law, affects only government and promotes an atmosphere of heightened racial divisiveness and will increase the possibility of litigation against state and local governments, and educational institutions resulting from their elimination of policies that strive to achieve inclusion for all groups. 5. Finally, to mitigate the divisiveness of this anti-affirmative action fervor by officially opposing the CCRI (Proposition 209). )264 RESOLUTION OF THE CITY OF SAN BERNARDINO HUMAN RELATIONS COMMISSION OPPOSING PROPOSITION 209 (THE "CALIFORNIA CIVIL RIGHTS INITIATIVE") BE IT RESOLVED BY THE HUMAN RELATIONS COMMISSION OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. WHEREAS, passage of Proposition 209 which purports to strengthen civil rights would instead deny civil rights be it resolved that the Human Relations Commission opposes Proposition 209. SECTION 2. THEREFORE, the Human Relations Commission requests that the Mayor and Council express their opposition to Proposition 209.
