SynopsiS of Previous Council ~ion:
08-20-84 Resolution No. 84-335 adopted declaring benefit to all
properties within district boundary.
11-08-84 -- Resolution No. 84-448 adopted determining public interest,
convenience and necessity require formation of maintenance
district and establishing district.
06-19-89 Resolution No. 89-195 adopted awarding a contract to C & D
Landscaping for the low bid price of $13,870.00.
06-04-90 Resolution No. 90-196 adopted awarding a contract to
Mentone Turf Supply for the low bid price of $12,705.00.
06-03-91 Change Order No. One, extending the contract one year, at
no increase in the contract prices, approved.
05-18-92 Change Order No. 2 approved, expanding the scope of the
contract to include Zone 1 of the Shandin Hills Lncp.Area.
Recommended motion:
1. That Change Order No. Three to the contract with Mentone Turf Su~ply,
for the maintenance of landscaping in Assessment District No. 959, in
accordance with Plan No. 6360, be approved 1 to expand the sc:ope of
work to include landscape areas on Kendall Drive and Shandin H:i.:cls
Circle, at an increase in the annual contract price of $28,9')3.081
extend the term of the contract for a one year period, from 7"1-92, to
6/30/93 1 and increase the original contract unit prices by 3.75%.

The Special provisions provide that the contract may be
extended for up to two (2) one-year periods, by mutual consent of
the City and Contractor. Adjustments in the contract prices are
to be negotiated at the time of each such renewal. Mentone Turf
Supply previously agreed to an extension of the contract for one
year, from July 1, 1991, to June 30, 1992. Contract Change Order
THREE extends the contract for the second one-year period.
Landscaping on portions of Kendall Drive and Shandin Hills
Circle has been installed by the subdivider, as required by the
conditions of approval for Tract No. 12958. The one-year plant
establishment period will terminate on 6-30-92, and the land-
scaping will be accepted by the City for maintenance as of 7-1-
92.
Contract Change Order No. THREE will extend the contract
for a period of one year, from 7-1-92 to 6-30-93, at a 3.75%
increase in the contract unit prices, and expands the scope of
work to include the landscaping along a portion of Kendall Drive
and Shandin Hills Circle.
Below is an estimate of the total cost for providing these
landscape maintenance services, from 7-1-92 to 6-30-93.

Funds to finance the costs incurred for the contract and
incidental costs will be provided through an interfund loan from
the Sewer Line Construction Fund (245). The actual costs in-
curred will be recovered in the following year through assess-
ments on the parcels within Assessment District No. 959.

Inspection of the maintenance effort by the Contractor
will be provided by the Department of Parks, Recreation and
Community Services.
We recommend that Contract Change Order No. THREE be
approved, and authorization granted for an inter fund transfer
from the Sewer Line Construction Fund (245).

1. The term of the contract is hereby extended for an addition-
alone year period, from 7-1-92 to 6-30-93, as provided in
the "Notice Inviting Bids," at a 3.75% increase in the
contract unit prices, for the original contract item, and
expanding the scope of the contract to include a portion of
Kendall Drive and Shandin Hills Circle.

INTERFUND LOAN FROM THE SEWER LINE CONSTRUCTION FUND (245) TO THE
3 SPECIAL ASSESSMENT FUND (251), IN THE AMOUNT OF $185,721. 00 TO
FRONT THE ESTIMATED COSTS TO BE INCURRED DURING THE 1992-93
4 FISCAL YEAR, IN CONNECTION WITH THE MAINTENANCE OF LANDSCAPING IN
TRACT NO. 12958, THROUGH ASSESSMENT DISTRICT NO. 959.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Director of Finance is hereby directed to
8 make an interfund loan from the Sewer Line Construction Fund
9 (245) in the amount of $185,721.00, to front the estimated costs
10 to be incurred during the 1992-93 Fiscal Year, in connection with
11 the maintenance of landscaping in Tract No. 12958, through
12 Assessment District No. 959.
13 SECTION 2. The loan from the Sewer Line Construction
14 Fund (245) shall be repaid with interest, at the prevailing
15 portfolio rate, in the 1993-94 Fiscal Year from assessments
16 placed on the parcels within Assessment District No. 959.
