That the City Administrator be instructed to develop a loan agreement for the purpose of borrowing $ 8,500. 00 from the Sewer Line Construction Fund (245), to front the estimated costs that will be incurred in the 1992/93 Fiscal Year, for maintenance of landscaping on portions of Irvington Avenue, in Assessment District No. 997, in accordance with Plan No. 8301. The Sewer Line Construction Fund (245) will be repaid in the 1993/94 Fiscal Year from assessments on the parcels within the district. CITY OF SAN BERARDINO - REQUEST Q)R COUNCIL ACTION STAFF REPORT Bids for this project were opened at 2:00 p.m. on Tuesday, May 5, 1992. A total of 5 bids were received, ranging $8,945.00. TOTAL ESTIMATED ANNUAL COST 3,000.00 $ 7,453.00 1,047.00 $ 8,500.00 The formation of this district was a condition of approval for the development of Tract No. 14949. The district was formed in 1990, but no work was done other than the formation arid preparation~ of annual assessment rolls. This is the first contract let for the actual maintenance for a portion of the landscaping in the District and represents only the area along the north side of Irvington Avenue. Landscaping along Irvington Avenue was installed by the subdivider, and has been accepted by the City. The Engineer's Report provides that funds to finance the costs incurred for maintenance of this landscaping will be ad- vanced by the City from the General Fund. Actual costs are recovered in the following fiscal year through assessments on the properties within the district. The assessment District Reserve Fund was established to provide a source of funds to finance advance costs incurred for work in assessment districts. This fund is being used to finance the advance costs for some districts, but there are not sufficient funds available to cover the costs for this district. Q f;?a:=> iD ~I z ~ iD is Il.Ul III , I ,.-1 - - III .J o o 1 2 RESOLUTION NO. 3 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO EXECUTIVE LANDSCAPE CONTRACTORS, INC. FOR MAINTENANCE OF LANDSCAPING IN PORTIONS OF IRVINGTON AND CHESTNUT AVENUES IN ASSESSMENT DISTRICT NO. 997. SECTION 1. Executive Landscape Contractors, Inc., is the lowest responsible bidder for: Maintenance of Landscaping in 8 portions of Irvington and Chestnut Avenues in Assessment District 9 No. 997, per Plan No. 8301. A contract is awarded accordingly to 10 said bidder for the Basic Bid of $3,073.00, and supplemental 11 items of $1,380.00, for the total amount of $4,453.00, but such 12 award shall be effective only upon the contract being fully 13 executed by both parties. All other bids, therefore, are hereby 14 rejected. The Mayor is hereby authorized and directed to execute 15 said contract on behalf of the City; a copy of the contract is on 16 file in the office of the City Clerk and incorporated herein by 17 reference as fully as though set forth at length. 18 SECTION 2. This contract and any amendment or modi fica- 19 tions thereto shall not take effect or become operative until 20 fully signed and executed by the parties and no party shall be 21 obligated hereunder until the time of such full execution. No 22 oral agreements, amendments, modifications or waivers are 23 intended or authorized and shall not be implied from any act or 24 course of conduct of any party. 25 SECTION 3.
