DescriDtionl Tippecanoe Ave. widenina (110 - Hardt Finance: (~AJt-'- Council Notes: Agenda Item No M CITY OF SAN BE.QARDINO - REQUES,oOR COUNCIL ACTION STAFF REPORT The Public Works Department is in the process of obtaining bids for the Tippecanoe Avenue Widening and Improvement Project. The project requires the acquisition of additional right-of-way along the east side of Tippecanoe, ranging between 7 and 17 feet. Negotiations with owners have been conducted through Realco Consultants, the City's contract right-of-way agent. Offers to purchase based upon appraised value have been tendered to all owners whom Realco has been able to locate, as required by Government COde 57267.1. A number of owners have settled, and it is expected that more will settle soon. However, because some parcels have complex title problems, or because owners of others are unwilling to settle based on the City's appraised value, it appears that an eminent domain proceeding will be necessary to acquire all of the additional right-Of-way. Adoption of a Resolution of Necessity is the formal legal step under the Eminent Domain Law the Mayor and COuncil must take to commence the proceeding. The law requires that the owners be afforded a hearing prior to adoption of the Resolution, in which the following are the issues to be determined: ( 1 ) whether the publiC interest and necessity require the project; (2) whether the project is planned or located in the manner that will be compatible with the greatest public good and the least private injury; and (3) whether the property sought to be acquired is necessary for the project. Notice of this hearing was given to each owner shown on Exhibit "C. attached to the proposed Resolution of Necessity. The hearing is not the time or place to negotiate with owners or hear complaints about the City's appraisal values. We strongly advise that discussion be limited to matters germane to the three issues outlined above. We recommend that following the hearing, the Mayor and Council adopt the attached Resolution of Necessity. RESOLUTION OF THE CITY OF SAN BERNARDINO FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRES THE ACQUISITION OF CERTAIN REAL PROPERTY IN FEE FOR PUBLIC PURPOSES AND ALL USES APPURTENANT THERETO ALONG TIPPECANOE AVENUE BETWEEN LAURELWOOD DRIVE AND HARDT STREET BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That on June 1, 1992, after at least fifteen (15) days written notice to the owners of property listed in Section 3 of this resolution, the Mayor and Common Council held a hearing for the purpose of allowing the owners a reasonable opportunity to appear and be heard on the following matters: a. Whether the public interest and necessity require the project; b. Whether the project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; and c. Whether the property sought to be acquired is necessary for the project. SECTION 2. The Mayor and Common Council of the City of San Bernardino, as a result of the above hearing, determined that the public health, safety and welfare requires the acquisition by the Ci ty of portions of certain parcels of real property, more particularly described in Exhibit "A", and depicted in relation to the proposed project by maps in Exhibit "8", attached and incorporated by reference, for widening Tippecanoe Avenue between Laurelwood Drive and Hardt Street, a public purpose. The acquisi tion is authorized by Section 19 of Article 1 of the California Constitution; Sections 1, 40. and 240 of the City RJM:ms[tippe.res] 1 , , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o o Charter; Section 37350.5 qf the California Government Code; and Sections 1240.010 through 1240.050 of the California Code of Civil Procedure. SECTION 3. The owners of property to whom notice of said hearing was mailed are set forth on Exhibi't "C", attached hereto and incorporated herein by reference. The mailing addresses of the owners include 'those shown on 'the last equalized county assessment roll, as required by law. SECTION 4. The Mayor and Cornmon Council of the City of San Bernardino hereby find and determine and declare that: (a) the public interest and necessity requires the proposed project and the acquisition by the City of fee simple title in the properties, for public street purposes and all appurtenant uses, (b) the location of the proposed project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; (c) the properties and the taking of the interest in the properties, as above described, are necessary for 'the proposed project; and (d) offers required by Section 7267.1 of the Government Code have been made to the owners of record, or the offer has not been made because the owner cannot be located with reasonable diligence. SECTION 5. The Mayor and Cornmon Council of the City of San Bernardino does hereby declare that it is the intention of the City to acquire these properties in its name in accordance with the provisions of the laws of the State of California with reference to condemnation procedures. SECTION 6.
