CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect Resolution of the City of San Bernardino authorizing the execution of an agreement with the State of California, 911 Office to participate in the 911 Emergency Number System, the purchase of an upgrade to the City's Public Safety Answering Point (PSAP) 911 telephone system and the purchase of a five year maintenance plan for the 911 system from Verizon Communications of Thousand Oaks, California. Back2round In October 1995, the Police and Fire Dispatch Centers were moved from the basement of City Hall into a combined Public Safety Dispatch Center located in the Police Department. At that time, the State of California provided, at no cost to the City, an upgraded 911 Public Safety Answering Point (PSAP) telephone system. The purcj1ase warranty was funded by the State of California until February 2002. In December, 2002, the State of California reimbursed the City of San Bernardino for an upgrade to the existing PSAP telephone system (The State of California requires PSAP telephone systems to be upgraded once every five years.). The existing PSAP telephone system warranty expired on June 30, 2008. The State of California collects 911 taxes from telephone bills statewide. These funds are intended to cover the costs associated with maintaining and upgrading the 911 equipment used by local law enforcement and fire service agencies to answer the public's emergency 911 telephone calls. > The State of California, Department of General Services, 911 Office has authorized the City of San Bernardino to upgrade the existing "Vesta" 911 software and telephone equipment. Because of fund verification delays in Sacramento, the replacement of the existing telephone system has been authorized as an urgent priority. However, State funding rules require that the City sign an agreement, "Emergency Number System Plan/Agreement" (TD-280), to be eligible for reimbursement for this project. By signing the TD~280 form, the City agrees to participate and maintain a 911 Emergency Number System (PSAP) as described in California Government Code 53100 et seq. and the California Standards for 911 Systems published by the State 911 Office. By accepting the State's financial assistance, if the five year commitment is not met a financial penalty will be imposed for the remaining period of the 911 equipment and network services cost as provisioned in Attachment A. The TD-280 must by signed by the Chief of Police and the Director of Finance. The State of California allows three vendors to provide "Vesta" 911 equipment to agencies in California. Two of the vendors (Verizon lII\d ATT) responded with quotes. The third vendor (Plant Electronics Inc, the manufacturer) refused to provide a quote stating that this installation was too small for their team. o o o Vendor: Verizon Communications A'IT Plant Electronics Inc. Quote Amount $ 259,835.63 $ 243,770.88 No Quote Because the system is out of warranty, maintenance problems must be paid on a time-and- materials basis. Based on our regular volume of service calls, we estimate monthly time-and- materials costs to be approximately $5,000.00 per month. It is estimated that it will take at least 120 days from award to complete the upgrade; therefore, $20,000.00 is needed to fund maintenance. Verizon Communications has offered to waive this cost if awarded the bid. A'IT can not provide maintenance to the existing system; they can only provide maintenance to the system that they insta11. With the discount for free maintenance during the upgrade, Verizon Communications has the lowest cost. Therefore, it is recommended that the City continue using Verizon Communications as the system and maintenance provider and pursuant to San Bernardino Municipal Code 3.04.01O(bX3), the Mayor and Common Council approve a selected source justification for the upgrade and maintenance of this public safety 911 telephone system. Verizon Communications' Public Safety Services Group will not sign a City of San Bernardino Vendor Service Agreement for this project. They explain that they are accountable to the State of California 911 Emergency Communications Office (911 Office) for this project under State contract 5-06-58-18 (See attached copy of State TD-288). Ms. Sofia Long, our 911 Office account manager indicates that a local contract for this State approved purchase is not necessary. Financial Imoact A total of $259,835.63 from the State of California's 911- Equipment and Services Fund has been allocated for this purchase. The funds available for this type of qualifying purchase are classified as ''911 equipment funds" that are part of our Fiscal Year 2007/2008 allotment for the 911 telephone system upgrade. The City of San Bernardino has received a "Commitment to Fund 911 Equipment and Services Form (TD-288) from the State of California's 911 Office. The City of San Bernardino will be reimbursed 100 percent of this purchase provided that a copy of the invoice, proof of payment (copy of cancelled checks) and the required 911 Office forms are submitted to the State. The Public Safety Systems Group of the City's Information Technology Department shall be responsible for coordinating the submission of reimbursement documents. This purchase will save the City $259,835.63 in General Fund dollars over the course of Fiscal Years 2008-2009 through 2012-2013. At the end of this five year maintenance contract, the City will have to fund about half of the purchase of a digital PSAP 911 telephone number because of new digital requirements that begin in September 2008. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council authorize the Chief of Police and the Director of Finance to sign an "Emergency Number System Plan! Agreement" (TD-280), on behalf of the City to participate in the State's 911 Emergency Number System. A copy of said document is attached hereto as Attachment "A" and incorporated herein. SECTION 2. That the Mayor and Common Council approve a selected source bid exemption allowing the Police Department to use Verizon Communications, of Thousand Oaks, California as the 911 telephone system installer and maintenance provider for the Public Safety Dispatch Center's Public Safety Answering Point (PSAP) 911 telephone system because of their qualifications and experience with the existing 911 telephone system (per Municipal Code 3.04.010 (b)(3)). SECTION 3. That the Mayor and Common Council authorize the Purchasing Manager to issue a Purchase Order to Verizon Communications, of Thousand Oaks, California for the purchase of an upgrade to the existing PSAP 911 telephone system and for a five year maintenance agreement for the 911 telephone system as outlined in Verizon's Quote #8- 2T5BF9. The Purchase Order shall read "San Bernardino PD PSAP 911 Telephone System Upgrade and Five Year Maintenance Plan.
