BACKGROUND The Facilities Management Department oversees the Parking Enforcement Division of the City. This division employs five full-time and four part-time Parking Enforcement Officers who issue parking citations for violations set forth in the Municipal Code and California Vehicle Code. Penalties for these violations are set forth by the governing body of the jurisdiction where the violation is issued (CVC 40203.5.a). Staff performed a review of parking violation penalties with cities in the east valley area of the County. The review indicated that San Bernardino was five dollars lower on many violations. The study also indicated that San Bernardino was the only City using a two-tiered late fee, one tier for late payment and the second tier for citations that had gone to lien against the vehicle registration. The current practice among the cities polled is to have one late fee for both, that is imposed after 21 days of issuing the citation, or 14 days after the mailing of the notice of a o delinquent parking violation. The new single-tier late fee will be thirty-five dollars. FINANCIAL IMPACT Implementing both of the increases noted above would net the City an increase of $150,000 per year based upon the annual issuance of 24,000 parking citations. This additional revenue was included in the budget-balancing recommendations recently adopted in concept by the Mayor and Common Council. RECOMMENDATION Adopt Resolution o RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ESTABLISHING THE SCHEDULE OF PENALTIES FOR PARKING VIOLATIONS SET FORTH IN THE CITY OF SAN BERNARDINO MUNICIPAL CODE AND THE CALIFORNIA VEIDCLE CODE, AND AMENDING PART VIII OF RESOLUTION 2008-149. 3 4 5 6 WHEREAS California Vehicle Code Section 40203.5 requires the schedule for parking penalties for parking violations and late payment penalties to be established by the governing body of the jurisdiction where the notice of violation is issued; and 7 8 WHEREAS the City of San Bernardino, in establishing parking penalties, has attempted to standardize such penalties with other issuing agencies within the County of San Bernardino. 9 10 11 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 12 SECTION 1.
